What it does
This instrument is an airworthiness directive (AD) issued by the Civil Aviation Safety Authority (CASA) under its delegated powers. It mandates a suite of mandatory modifications, flight manual revisions, and operating restrictions on ATR 42‑200, 42‑300 and 42‑320 aircraft to address a safety risk associated with using the 45‑degree flaps setting. The core mechanical change is the removal of the previously permitted operational exemption that allowed certain operators to use flaps at 45 degrees in normal service. The AD requires all affected aircraft to be physically altered so that the maximum permissible flaps extension in normal operations is 30 degrees, not 45. This is achieved through three distinct aircraft‑specific actions. First, the Aircraft Flight Manual (AFM) must be revised by incorporating Temporary Revision (TR) No. 51, which restricts the 45‑degree configuration to “emergency operations by decision of the captain” and only when no icing conditions have been encountered during the flight and the aircraft is confirmed clear of ice. Second, for aircraft that have not embodied modification (Mod) 01192 or Service Bulletin (SB) ATR42‑27‑0008 at any revision, a mechanical stop must be installed and new speed‑limit placards fitted per SB ATR42‑27‑0008 Revision 6 or later EASA‑approved revision. Third, for specific manufacturing serial numbers (MSN 027, 102, 106, 214) that were previously modified under SB ATR42‑27‑0080 (the exemption route), that modification must be undone; the aircraft must be re‑restricted to 30 degrees and new placards fitted per SB ATR42‑27‑0099. For MSN 097 not previously modified per SB ATR42‑27‑0008, and for MSN 403, the aircraft must be modified per SB ATR42‑27‑0099. For all other aircraft not covered by these specific categories, the operator must check that the red‑colour mechanical stop is already installed on the flaps control and that the speed‑limits placard correctly states “EMER: (45°). 130 kt”. Any discrepancy requires contacting ATR for a restoration procedure. The AD also explicitly prohibits the future installation of Mod 01314 or implementation of SB ATR42‑27‑0080 on any aeroplane. Compliance deadlines are staggered: the AFM revision must be done within 7 days after the effective date (16 July 2008), while the physical modifications, checks, and placard updates must be completed within 6 months. This AD supersedes the earlier Direction Générale de l’Aviation Civile (DGAC) France AD F‑1986‑130‑003, which had previously allowed national aviation authorities to grant operational exemptions for using flaps 45 degrees at specific airfields. The practical effect is that any aircraft that had previously been exempted is now required to revert to the restricted configuration, eliminating operator discretion to seek or rely on such exemptions. The AD does not create any new rights; it imposes mandatory obligations and prohibits a prior practice.
