What it does
This Order substitutes references to Ministers, Departments and Secretaries that appear in Commonwealth Acts and instruments so that when those statutes or instruments refer to an office-holder or agency by an earlier title, the reference is read as a reference to a later title listed in the Order. The Order is titled Acts Interpretation (Substituted References,Section 19BA) Order 2004 (s 1). The Order defines the unit it affects as a "provision", meaning any provision in an Act or in an instrument under an Act (s 2). Mechanically, the Order operates by instructing that a provision mentioned in the relevant schedule item "has effect on and from the date mentioned in the heading to that Part, as if there were substituted a reference to" the replacement office or agency (ss 3-5). The operative instruments for substitution are Schedule 1 (References to Ministers), Schedule 2 (References to Departments) and Schedule 3 (References to Secretaries), each of which identifies, by item, an existing reference, the substitute reference and the affected provisions.
The Order covers multiple staged substitutions. Parts of the Schedules record substitutions made on particular dates (for example Part 1,Substitutions made on 18 November 2004; Part 2,Substitutions made on 18 December 2007; Part 3,Substitution made on 21 May 2010; Part 4,Substitutions made on 16 October 2010; Part 4A,Substitutions made on 14 December 2011; and Part 5,Substitutions made on commencement of the Acts Interpretation (Substituted References,Section 19BA) Amendment Order 2015 (No. 1)). Each Part heading supplies the date from which the listed substitutions are to be read into the affected provisions. The Schedules list, as affected provisions, named Acts (for example the Plant Breeder’s Rights Act 1994, Disability Services Act 1986, Social Security Act 1991, Copyright Act 1968, Privacy Act 1988, Australian Hearing Services Act 1991), specified subsections, or classes of instruments made under those Acts. Some entries include explicit carve-outs (for example, the Copyright Act entry in Part 5 excludes subsection 183(6); the Australian Hearing Services Act entries exclude subsections 8(4) to 8(8)). The Order expressly states that a provision in a Schedule may have been affected before its commencement by other substituted-reference orders under sections 19B or 19BA of the Acts Interpretation Act 1901, and may be affected after commencement by an order made under s 19BB or other s 19BA orders (the Note following s 5). In short, the instrument does not change substantive policy in the named Acts; it changes the office-holder or agency name that is to be read into existing provisions with the legal effect that where a statute or instrument refers to an old office or agency, it is read as referring to the new office or agency from the date the relevant Part takes effect (ss 3-5).
