### 39A Regulations to be judicially noticed
> *\[Section 39A Inserted by No. 40 of 1985, s. 7 \]*

> > (1) Subject to [subsection (2)](#GS39A@Gs2@EN) , judicial notice shall be taken of regulations made or purporting to be made under an Act –
> >
> > > > (a) that are published in the *Gazette*, in the case of regulations that are not statutory rules within the meaning of the [Rules Publication Act 1953](/view/html/inforce/2026-04-12/act-1953-050) ; or
> > >
> > > > (b) the making of which is notified in the *Gazette*, in the case of regulations that are statutory rules within that meaning.
>
> > (2) Notwithstanding [subsection (1)](#GS39A@Gs1@EN) , a court, judge, or justice may require proof of the making of any regulations referred to in that subsection or of their publication in the *Gazette*, or, as the case may be, of the notification in the *Gazette* of their making.
