Accommodation Providers Act 1981

The Act defines three central concepts: “accommodation establishment”, “accommodation provider” and “guest”. An accommodation establishment is any common inn or premises held out as providing sleeping accommodation without special contract to persons who appear able and willing to pay (section 3(1)(a)), plus any premises used for board and lodgings as a commercial enterprise including boarding houses, guest houses and lodging houses (section 3(1)(b)), and any facility prescribed by regulation (section 3(1)(c)). Importantly, the definition expressly excludes caravan parks and the erection or placement of tents, mobile homes or cabins for providing board and lodgings as a commercial enterprise (section 3(1)), but the Regulations may override that exclusion to prescribe such facilities as accommodation establishments (section 3(1A)). This gives the Executive the power to extend the Act’s regime to new accommodation formats, such as glamping sites or short-term rental platforms, without amending the primary legislation. An accommodation provider is simply the operator of such an establishment (section 3(1)). A guest is defined restrictively in section 4: a person is a guest only when sleeping accommodation at the establishment has been engaged by or for them. This means that a person who merely uses the restaurant, bar, function room or other facilities without having booked a room is not a guest under the Act and cannot rely on its provisions (or its cap). Their rights would be governed by ordinary contract or tort law. The property covered is “property brought to an accommodation establishment by or on behalf of a guest” (section 5), which extends to luggage, personal effects, and items brought by the guest or by their agent. The Act also introduces the concept of a “lien” in sections 9 to 11, which is a right to retain possession of guest property until the charges are paid. The lien is not a possessory lien in the common law sense limited to goods bailed; it is statutory and arises automatically upon non-payment for food, drink, accommodation or services. The provider may enforce it by sale after 28 days, but only via public auction with prescribed notice steps. The cap in section 6(1) is denominated in “monetary units”, a reference to a unit of value fixed under Northern Territory legislation. As at the version in force (1 July 2022), the amount is 750 monetary units, though the Regulations may prescribe another amount. Importantly, the amount in force at the time the loss or damage occurred governs (section 6(1A)). This avoids confusion where the cap changes between the date of loss and the date of judgment. The two main defences under section 8 are: (a) that the loss or damage was caused by the guest’s misconduct or negligence, or that of the guest’s servant or companion, or an act of God or the Crown’s enemies; and (b) that the guest had assumed exclusive charge and custody of the room where the property was at the relevant time.

The Act applies primarily to accommodation providers in the Northern Territory: operators of hotels, motels, boarding houses, guest houses, lodging houses, and any facility prescribed as an accommodation establishment. This includes both licensed and unlicensed premises under the Liquor Act 2019 (section 3(1) specifically states “irrespective of whether it is licensed”). Providers of short stay accommodation such as bed and breakfasts, hostels, and serviced apartments that offer sleeping accommodation without a special contract and hold themselves out to the public are likely covered. Caravan park operators and those offering only tents, mobile homes or cabins are not covered unless a regulation prescribes them (section 3(1) and 3(1A)). This exclusion may create competitive distortions: a cabin park operator outside the Act faces unlimited common law liability for guest property (subject to contract and tort), while a hotel operator across the road is capped. Similarly, peer-to-peer platforms like Airbnb that facilitate booking of private homes may fall outside the definition unless they are “held out” as providing sleeping accommodation without special contract. The operator of a single private home let occasionally may not be an “accommodation provider” as they are not running a commercial enterprise. The Act’s reach depends on the facts. Guests are directly affected because their recovery for lost or damaged property is capped at 750 monetary units per incident, unless they can bring their claim within one of the exceptions (provider’s default, deposit for safekeeping). This cap applies regardless of the actual value of the property, meaning a guest who loses a laptop worth $2,000 will recover no more than the cap. Insurance implications are significant: guests may need personal travel insurance to cover valuables, and providers may rely on the cap to limit their liability exposure. The Act also affects auctioneers, newspaper publishers (who must publish sale notices under section 10(2)(a)), and the Public Trustee, who receives surplus sale proceeds as unclaimed moneys under section 11(2). Finally, the Administrator and the Executive are affected through the regulation-making power to prescribe new facilities and alter the cap, which expands state discretion and allows adjustment without parliamentary scrutiny.

The Act imposes one primary duty on accommodation providers: to display the Schedule notice in plain type conspicuously in the guest’s sleeping accommodation and at or near the reception desk (or main entrance if no reception desk) at the time property is brought to the establishment (section 6(2)). If the provider fails to display the notice at the relevant time, the liability cap in section 6(1) does not apply, and the provider faces unlimited liability (subject to the defences in section 8). The notice is defined in the Schedule; the 2022 amendment updated its reference but preserved notices displayed before the amendment (section 13). There is no duty under the Act to accept property for deposit, but if the provider does accept property for deposit, or if a guest offers property for deposit and the provider refuses or is unable to accept it (through the provider’s default), the cap does not apply (section 6(3)(b) and (c)). This creates an incentive for providers to have clear policies about accepting guest valuables for deposit, and to train staff not to refuse deposits lightly (or to ensure they are able to receive them). Providers also have the right to exercise a lien over guest property for unpaid charges (section 9), but they must not exercise that lien over vehicles or property left in vehicles, as section 7(2) expressly removes the lien for such items. The right of sale under section 10 is conditioned on the debt remaining unpaid for 28 days after it becomes due and payable, and requires the provider to give at least 7 days’ notice of the proposed auction by advertisement in a local newspaper and by registered mail or personal service on the guest. The notice must include the guest’s name, amount owed, time and place of sale, property to be sold, and the auctioneer’s name (section 10(3)). The sale must be by public auction; private sales are not authorised. The proceeds are applied first to the debt, then to sale costs, and the surplus must be paid to the guest upon application within one month, or otherwise to the Public Trustee (section 11). For guests, the key rights are to recover up to the cap for property lost or damaged while at the establishment (provided the notice was displayed), to have property deposited for safekeeping accepted, and to receive surplus after a lien sale. Guests also have the right to contest that the loss was due to their misconduct or negligence, or that they assumed exclusive charge of the room, which would shift liability back to them (section 8). The Act does not create additional rights beyond these property protections; it does not address personal injury, privacy, or other common law claims.

The Act does not create criminal offences or pecuniary penalties for non-compliance. The enforcement mechanism is entirely civil. If the accommodation provider fails to display the required notice, it loses the protection of the liability cap and faces potentially unlimited liability for guest property loss or damage (section 6(2)). This is a powerful economic penalty: a provider who neglects the notice requirement may be exposed to claims far exceeding the cap. Conversely, if the provider displays the notice and none of the exceptions apply, the guest’s recovery is capped at 750 monetary units (or prescribed amount). Enforcement of the cap is a matter for the court in any civil proceeding brought by the guest. The provider must plead and prove the notice was properly displayed at the relevant time, and the guest may challenge that. The defences under section 8 are also matters to be proved by the provider on the balance of probabilities. There is no penalty for wrongfully exercising the lien or conducting an invalid sale; however, improper sale may expose the provider to claims in conversion or detinue at common law, and the guest could recover damages in excess of the debt. The sale procedure in section 10 is mandatory: the 28 day waiting period, the two forms of notice, and the public auction requirement are all conditions precedent to a valid sale. A sale not conducted in compliance with these requirements would be unauthorised, and the provider could be liable for the full value of the property sold, not just the cap amount, as the statutory authority to sell would be absent. Similarly, applying sale proceeds in the wrong order or failing to pay surplus to the guest or Public Trustee could result in liability. The Act does not provide a statutory cause of action for guests; they must rely on common law negligence, bailment, or contract. The Act merely modifies the quantum of liability and the availability of the lien. Enforcement therefore occurs through the ordinary civil court system. The reduced cap may encourage faster settlements, as small claims are less costly to contest. However, the cap also reduces the deterrent effect on providers who negligently cause loss: if the cap is low, the provider’s cost of care may be suboptimal, as the marginal benefit of precaution (avoiding a capped loss) may be less than the cost of the precaution.

Section 3(3) expressly abolishes the common law rights and liabilities of innkeepers with respect to guest property for hotel keepers as at the Act’s commencement. Section 3(4) extends that abolition to operators of facilities prescribed later as accommodation establishments. This means the old strict liability regime under which innkeepers were insurers of guest property (with limited exceptions) no longer applies. The Act operates as a code for the matters it covers. However, it does not purport to affect liability for loss or damage caused by the provider’s default, neglect or wilful act, or that of their servant (section 3(2)). The common law cause of action in tort or contract survives for losses exceeding the cap, but the cap limits recovery unless one of the section 6(3) exceptions applies. The Act does not affect liability for personal injury; that remains under common law and other statutes such as the Civil Liability Act (NT). The Liquor Act 2019 is referenced only to confirm that liquor licensing status is irrelevant to whether a premises is an accommodation establishment. The Motor Vehicles Act 1949 is referenced in the definition of “vehicle”. The Act may interact with consumer protection laws: if a guest books accommodation online, the Australian Consumer Law (as applied in the NT) may impose guarantees as to due care and skill. The cap under this Act does not override consumer guarantees; if a loss results from a failure to meet a consumer guarantee, the guest may have rights beyond the cap. However, the scope of that interaction is untested in the source. The Act’s regulation-making power under section 12 allows the Administrator to prescribe matters, including the cap amount and facilities to be included. This creates a delegating of legislative power that can alter liability limits without Parliamentary debate. The transitional provision (section 13) deals with the 2022 amendments to the Schedule, preserving previously displayed notices as compliant with the updated form. The Act is also likely subject to the Property Law Act (NT) and other common law principles of bailment, but the Act displaces those principles to the extent of any inconsistency. Finally, the public auction requirement may interact with the Auctioneers and Agents Act (NT) regarding licensing of auctioneers.

The Act was originally enacted as the Hotel keepers Act 1981 (Act No. 58, 1981) and commenced on 11 December 1981. In 2002, the Hotel keepers Amendment Act 2002 (Act No. 36, 2002) made significant changes: it renamed the Act to the Accommodation Providers Act 1981, substituted “accommodation provider” and “accommodation establishment” for references to “hotel keeper” and “hotel”, broadened the definition of accommodation establishment to include boarding houses, guest houses and lodging houses, and updated provisions including adding section 12 (Regulations) and amending sections 1, 3, 4, 5, 6, 7, 8, 9, 10, 11 and the Schedule. This renamed the entire regime and extended it beyond traditional hotels. The Liquor Act 2019 (Act No. 29, 2019) made a minor amendment to the definition in section 3 to reference that Act instead of the repealed Liquor Act. The Justice and Licensing Legislation Amendment Act 2022 (Act No. 6, 2022) commenced in part on 1 May 2022 and remaining on 1 July 2022. It amended section 6 (replacing the phrase “monetary units” and adjusting the Schedule reference), inserted section 13 (transitional matters) and amended the Schedule to change the notice wording. The version as in force at 1 July 2022 is the current version in the source. No subsequent amendments are reflected. The Act has remained largely stable in structure since 2002, with only terminology and Schedule adjustments. The transition from “hotel keepers” to “accommodation providers” reflected the modernisation of the NT accommodation industry beyond traditional inns, but the exclusions for caravan parks and temporary structures remained, creating an arbitrary line that may be outdated given the growth of glamping and mobile cabins.

No case law is cited or discussed within the source text; the Act itself does not reference any judicial decisions. The Act’s provisions are not accompanied by explanatory notes or case references. Because the source is only the statute as in force, any litigation history must be inferred from the Act’s text. For example, section 8(b) (defence where guest assumed exclusive charge and custody of the room) is likely a response to common law disputes over whether the provider retains control of the room after check in. The defence suggests that if the guest takes full control (e.g., leaves the door unlocked, allows others access), the provider escapes liability. Section 6(3) exceptions (deposit for safekeeping) also indicate legislative sensitivity to the problems of proving deposit arrangements - the exception applies even if the provider “refused to receive” the property or was unable to receive it through default, which might reflect earlier litigation where guests claimed they tried to deposit valuables but were rebuffed. The existence of the notice requirement (section 6(2)) is a direct response to the English Innkeepers Act line of cases requiring posting of notices to limit liability. The 750 monetary unit cap (now adjustable by regulation) is likely based on a previous value fixed by the Act as originally enacted and updated by the 2002 amendment. Without access to case law databases, one can only note that the Act is susceptible to disputes over whether a facility is an “accommodation establishment” (especially with the regulation prescription power), whether a guest qualifies (section 4 only person who engaged sleeping accommodation), whether the notice was “conspicuously displayed”, and whether the guest assumed exclusive charge under section 8(b). Practitioners should search for NT decisions under this Act on AustLII, but the source does not supply them. The lack of cited litigation may indicate the Act is low volume or that its clear caps encourage settlement.

Several provisions contain traps for the unwary. First, the notice requirement in section 6(2) is strict: the notice must be displayed “at the time the property in question was brought to an accommodation establishment”. If the guest checks in and later brings property into the room, the notice must have been displayed before that time. A provider who puts up the notice after check in may lose the cap for any loss occurring before the notice was displayed. The notice must be “conspicuously displayed” in both the sleeping accommodation and at the reception desk (or main entrance). A small print notice in a drawer or behind the door may not be conspicuous. Second, the cap does not apply if the property was lost or damaged through the “default, neglect or wilful act of the accommodation provider or his servant” (section 6(3)(a)). The term “default” is undefined and could encompass any failure to take reasonable care, potentially nullifying the cap in many routine negligence cases. Third, the exception for property deposited for safekeeping (section 6(3)(b) and (c)) applies even if the provider refuses the deposit or is unable to receive it through default. If a guest asks to deposit valuables and the staff say “we don’t have a safe” or refuse, the provider loses the cap for that property. Providers who want the cap must train staff to accept deposits and maintain secure storage, or clearly inform guests in writing that deposits are not accepted (and argue that the property was “offered for deposit” and refused, which still triggers the exception - the exception requires refusal, so the provider cannot avoid it by having a policy of not accepting deposits; the guest must actually offer, and refusal triggers unlimited liability). This is a significant risk. Fourth, the definition of “vehicle” under section 3 includes a horse and carriage, which is archaic but still law. More practically, it includes any vehicle under the Motor Vehicles Act 1949, which includes cars, motorcycles, trailers, etc. Section 7(1) states the provider is not liable at all for vehicles or property left in or on a vehicle. This absolute exclusion applies even if the provider’s negligence caused the loss. A provider may owe a duty of care for safe parking but the liability cap under section 6 does not apply because the liability is excluded entirely, not limited. The guest cannot recover under the Act at all. Their only recourse is common law or contract, which may impose liability but without the cap. The Act does not preclude the common law claim; it simply states the provider is not liable “in his capacity as an accommodation provider”. That phrase may mean the Act does not create liability, but the common law may still do so. Fifth, the lien under section 9 is only over property “brought to an accommodation establishment”, not over property left behind after checkout. The sale procedure under section 10 requires 28 days from when charges “become due and payable”. If the provider demands payment at check out and the guest refuses, the 28 days start from that date. The sale notice must be given at least 7 days before the proposed sale, and if the guest’s address is known, by registered mail. A provider who sells property before 28 days or without proper notice may be liable for conversion. Sixth, the surplus proceeds must be paid to the guest on application within one month. After one month, the provider must pay the surplus to the Public Trustee as unclaimed moneys, not keep it. Seventh, the regulation power allows the Administrator to prescribe further facilities as accommodation establishments without parliamentary approval, potentially catching caravan parks or short stay rentals, creating retrospective liability.

To comply with the Accommodation Providers Act 1981 (NT), an operator should first determine whether the premises falls within the definition of “accommodation establishment”. If it provides sleeping accommodation to the public as a commercial enterprise without special contract, it likely does, unless it is a caravan park or uses tents, mobile homes or cabins (though check if a regulation prescribes them). The key compliance step is to ensure that the Schedule notice is displayed in accordance with section 6(2). Print the notice as it appears in the Schedule in plain type, large enough to be easily read. Display one copy conspicuously inside every guest sleeping accommodation (room, dormitory, cabin). Display another copy at the reception desk or, if no desk, near the main entrance. The notice must be up at the time the guest brings property in, so have it in place before check in. Take photographs or maintain a log to prove the notice was displayed if a dispute arises. Second, establish a policy for accepting guest property for deposit. If you have a safe or secure storage, train staff to accept deposits when offered. Refusing a deposit may expose you to unlimited liability. If you do not have deposit facilities, consider whether to install them. At a minimum, ensure you do not refuse a deposit without good reason, and document any refusal (date, time, guest name, reason). Third, understand that the liability cap does not apply if the loss is caused by your default, neglect or wilful act. This means that if you or your staff are negligent, the cap disappears. To mitigate risk, maintain reasonable security, supervise staff, and deal promptly with any hazards (broken locks, unsecured windows). Fourth, for vehicles, note that you are not liable under the Act, but you may still face common law claims. Consider disclaimers on parking, and if you offer secure parking, clearly state you are not liable for vehicle loss or damage under the Act. Fifth, if a guest fails to pay charges, exercise the lien correctly. Only retain property brought to the establishment by or on behalf of the guest. Do not retain vehicles or property left in vehicles. Wait 28 days from when the charges become due. Before selling, give at least 7 days’ notice: advertise in a local newspaper (one circulating in the area), and send registered mail to the guest’s last known address or personally serve a notice. The notice must state the guest’s name, debt amount, time and place of sale, property to be sold, and the auctioneer’s name. After the public auction, apply proceeds: first to the debt, then to sale costs, and hold any surplus. If the guest claims the surplus within one month, pay them. If not, pay the surplus to the Public Trustee. Keep records of all steps. Sixth, monitor the Regulations for changes to the cap amount or additions to the definition. Also note any amendments to the Schedule. The 2022 transitional provisions saved prior notices, but any new notices should use the current Schedule wording. Finally, obtain appropriate public liability insurance that covers the capped liability and consider whether the cap sufficiently protects you. The cap may be lower than the actual value of property guests bring; you may want to warn guests via signage that you recommend travel insurance. Compliance is largely about documentation and training, especially for front desk staff on accepting deposits and handling guest property.
