139 Consent to surrender

(1) If an application is made in accordance with section 138, the Secretary must consent to the surrender unless the Secretary is taking, or proposing to take, action to cancel or suspend the accreditation.

(2) The Secretary may impose any condition on the consent to surrender that the Secretary considers reasonably necessary to protect the interests of a third party.

(3) If the Secretary consents to the surrender of an accreditation under subsection (1) and imposes a condition on the consent, the person to whom the condition applies must comply with the condition.
