372 Section 98C (Non-economic loss) (1) Section 98C, as amended by section 60(1) of the amending Act, applies in respect of a claim, whether made before, on or after the commencement date, if a determination has not been made under section 104B(2) before that date. (2) Section 98C, as amended by section 90 of the amending Act, applies in respect of a claim whether made before, on or after the commencement date if the worker attends the first impairment assessment for the purposes of section 104B(2)(b) on or after that date.
