330 Section 92A (Revised compensation for death of worker) (1) Section 92A as amended by section 68(1) of the amending Act applies in respect of— (b) a claim for compensation that has not been determined by a Court immediately before the commencement date. (2) The definition of ***dependent child*** in section 92A, as amended by section 68(2) of the amending Act, applies to claims for compensation to which sections 92A and 92B apply, made on or after the commencement date. (3) Section 92A, as amended by section 68(3) of the amending Act, applies in respect of claims for compensation to which section 92A applies that have not been determined by the Court immediately before the commencement date. (4) Section 92A, as amended by section 68(4) of the amending Act, applies in respect of a claim for compensation that has not been determined by a court immediately before the commencement date. (5) Section 92A, as amended by section 68(5), (6), (7), (8), (9) and (10) of the amending Act, applies in respect of a claim for compensation that has not been determined by a Court immediately before the commencement date. (6) If subsection (5) applies to a claim, the interest to which a claimant is entitled on the amount of compensation payable under that claim is to be determined as follows— (a) interest at the prescribed rate on the relevant maximum sum set out in section 92A(4), (5), (6), (7), (8), (8A), (8B) or (9) immediately before the commencement date of section 68(5), (6), (7), (8), (9) and (10) of the amending Act, for the period beginning on the date the claim for compensation was made to immediately before the commencement date; and (b) interest at the prescribed rate on the relevant maximum sum set out in section 92A as amended by section 68(5), (6), (7), (8), (9) and (10) of the amending Act, for the period beginning on the commencement date to the date the claim is determined by the court or the Authority or self-insurer (as appropriate).
