134A Actions for damages only in accordance with this Act S. 134A(1) amended by No. 26/2000 s. 21. (1) A worker who is, or the dependants of a worker who are or may be, entitled to compensation in respect of an injury arising out of or in the course of, or due to the nature of, employment on or after 12 November 1997 but before 20 October 1999 shall not, in proceedings commenced in respect of the injury or otherwise, recover any damages of any kind. (2) Subsection (1) does not prevent the recovery of damages in proceedings under Part III of the **Wrongs Act 1958**, subject to and in accordance with the **Transport Accident Act 1986**, in respect of the death of a worker— (a) arising out of a transport accident within the meaning of the **Transport Accident Act** **1986**; and (b) arising out of, or in the course of, or due to the nature of, any employment that was a significant contributing factor resulting in or materially contributing to the death.
