119K Authority or self-insurer may extend or waive time limits (1) The Authority or a self-insurer may extend or waive any time limit specified in this Division (including a time limit imposed under subsection (4)) as it applies to a worker, on the written application of the worker. (2) The Authority or self-insurer may only extend or waive such a time limit if it is satisfied that the worker's failure to meet the time limit was due to special circumstances. (3) An application for the waiver of a time limit may be made at any time, either before or after the limit has expired. (4) In extending or waiving a time limit, the Authority or self-insurer must specify in writing a new time limit within which the relevant act must be done. (5) If the Authority or self-insurer extends or waives a time limit— (a) in the case of an extension, or a waiver that is granted before the time limit expires, the worker's entitlement to apply for a settlement on the expiration of that time limit does not cease on the expiration of that time limit; and (b) in the case of a waiver, any entitlement to apply for a settlement that ceased on the expiry of the time limit is revived; and (c) in the case of a worker seeking a settlement under Subdivision 1 or 2, the entitlement to apply for the settlement is to cease if the worker does not do the relevant act before the expiry of the time limit specified under subsection (4).
