Aboriginal Lands (Aborigines' Advancement League) (Watt Street, Northcote) Act 1982

The Act is short and centred on a property transfer plus restricted authorisation for resource activities. The main statutory concepts are:

• Crown grant to trustees: s 3(2) mandates that the Governor in Council shall issue a Crown grant of the Watt Street land to the trustees for the time being of the League. The grant is an instruction to the Crown executive to convey a freehold interest in the specified parcel to the League trustees, subject to conditions noted in the Act.

• Subject-to and notwithstanding clauses: s 3(2) uses a "notwithstanding anything to the contrary in the Land Act 1958 but subject to this Act" formulation. That means that, for the purpose of issuing the Crown grant, conflicting provisions in the Land Act 1958 are subordinated, but the grant remains subject to the terms of this Act itself, including the use condition in s 3(3). The Act therefore establishes a specific statutory pathway for this parcel that overrides inconsistent Land Act rules.

• Use condition and existing encumbrances: s 3(3) makes the Crown grant subject to the condition that the land continue to be used for an Aboriginal Community Centre. It also preserves "additional conditions, covenants, exceptions and restrictions (if any) as exist on the day on which this Act comes into operation," so pre-existing title encumbrances or statutory conditions survive the grant. Those matters are therefore part of the property bundle the trustees receive.

• Revocation of temporary reservation: s 3(1) revokes the Governor in Council Order of 27 October 1981 that temporarily reserved the land and had excepted it from prospecting and occupation for mining under any miner's right. The practical effect is to remove the temporary status and to transition to a Crown grant regime; however, some protections are recreated in the Act (see s 3(3) and s 3(4)).

• Consent requirement for mineral and petroleum authorities: s 3(4) bars any lease, licence, permit or other authority under the Mineral Resources (Sustainable Development) Act 1990 or the Petroleum Act 1998 from being granted over any part of the Watt Street land except with the consent of the governing body of the League, and then only on such terms and conditions as that governing body thinks fit. This creates a statutory role for the League’s governing body in consenting to resource tenures affecting the parcel.

• Definitions linking external statutes: the League is defined by reference to registration under the Hospitals and Charities Act 1958 (s 2). The resource-authority restriction points to separate resource statutes (Mineral Resources (Sustainable Development) Act 1990 and Petroleum Act 1998). The Act therefore operates in conjunction with other statutes, by reference.

• Schedule as plan: the Schedule contains the plan of the land, which identifies the parcel to which the Crown grant and all statutory conditions apply. The plan is part of the Act’s operative material.

• Amendment record: the Act text itself notes that s 3(4) has been amended by the Statute Law (Further Revision) Act 2002, the Mineral Resources Development (Sustainable Development) Act 2006 and the Resources Industry Legislation Amendment Act 2009. Those entries in the Table of Amendments indicate that the resource-consent provision has been the subject of later statutory editing.

Collectively, the concepts combine to transfer title into the League’s trustees, preserve pre-existing restrictions, impose a continued-use condition, and vest control over resource tenure on the parcel in the League’s governing body by statutory consent power.

The Act identifies specific actors and interests that are directly affected.

• The Aborigines' Advancement League (Victoria), described in the Act as "the League" (s 2): the League is the primary beneficiary. The Crown grant is to be issued to the "trustees for the time being of the League" (s 3(2)). The League’s governing body is given an explicit statutory role under s 3(4) to consent to any resource authority and to set the terms and conditions of that consent. The definition in s 2 links the League to its legal form as a benevolent society registered under Part III of the Hospitals and Charities Act 1958, so registration status under that Act is the referent for who counts as the League.

• The trustees for the time being of the League: they are the legal title-holders once the Crown grant is issued (s 3(2)). The Act contemplates a continuing office holder by using the phrase "for the time being", so the persons who occupy the trusteeship at any given time will hold the Crown title subject to the Act’s conditions.

• The governing body of the League: that body is given a statutory veto and contract-shaping power over mineral and petroleum authorities (s 3(4)). Any person or entity seeking resource authorities under the two named Acts must secure consent from the governing body before an authority can be granted.

• Victorian Crown and Governor in Council: the Governor in Council is directed to issue the Crown grant (s 3(2)) and is empowered to revoke the Order in Council from 27 October 1981 (s 3(1)). The Crown holds responsibility for implementing the transfer and for ensuring that grant conditions are recorded.

• Resource sector applicants and regulators: persons or entities that might otherwise apply for or be granted a mining, petroleum or related resource authority under the Mineral Resources (Sustainable Development) Act 1990 or the Petroleum Act 1998 are directly affected by s 3(4). They cannot obtain an authority over the Watt Street land except with the League's governing body consent and subject to such terms as that body imposes.

• Aboriginal people of Victoria: the preamble states that "it is in the interests of the Aboriginal people of Victoria that the land be vested in the Aborigines' Advancement League (Victoria)". That is a legislative purpose statement; the Act gives legal effect to vesting in the League, which the preamble identifies as intended to serve Aboriginal people of Victoria. The Act itself does not set out entitlements for particular individuals beyond vesting the land in the League trustees and imposing the use condition.

• Parties with existing interests in the land: s 3(3) preserves "additional conditions, covenants, exceptions and restrictions (if any) as exist on the day on which this Act comes into operation". Anyone holding existing encumbrances or who had rights or conditions recorded at commencement retains whatever rights or burdens exist, subject to the Crown grant being issued.

Indirectly affected actors include municipal or local governments and community groups that engage with the League on community-centre matters, but the Act does not confer statutory duties or direct rights on them. The Act does not create a standalone statutory enforcement office or impose fines; it changes property title and the regulatory pathway for resource authorities on the specified parcel.

The Act creates a concise set of duties and rights, mostly located in s 3.

Rights conferred

• Right to title: the trustees for the time being of the League are entitled to a Crown grant of the Watt Street land, as mandated by s 3(2). That is a statutory right to be made the grantee of Crown land.

• Rights to control resource tenure: under s 3(4) the governing body of the League has the right to withhold or grant consent to leases, licences, permits or other resource authorities under the Mineral Resources (Sustainable Development) Act 1990 or the Petroleum Act 1998 that would affect any part of the Watt Street land. When the governing body gives consent, it may impose "such terms and conditions as the governing body of the League thinks fit to impose" (s 3(4)). That gives the governing body substantive discretion to shape the terms of any resource authority affecting the parcel.

• Beneficial use: the grant is made subject to the condition that the land "continue to be used for an Aboriginal Community Centre" (s 3(3)). The trustees therefore have the right to continue using the land for that purpose.

Duties and constraints

• Duty to maintain specified use: the Crown grant is expressly made subject to the condition that the land continue to be used for an Aboriginal Community Centre (s 3(3)). While the Act does not spell out specific enforcement mechanisms for breach, the condition is part of the grant and therefore a legal constraint on the trustees’ use of the land.

• Acceptance of existing encumbrances: the grant is subject to any "additional conditions, covenants, exceptions and restrictions (if any) as exist on the day on which this Act comes into operation" (s 3(3)). Trustees take title subject to those pre-existing burdens, which imposes an obligation to respect them.

• Governing body’s consent function: the governing body has discretion over whether to consent to resource authorities and what terms to impose (s 3(4)). That discretion can be exercised to approve, refuse, or condition grants; exercising that discretion will be a governance duty of the governing body insofar as it may be accountable to the League and its stakeholders.

• Revocation of prior exception: s 3(1) revokes the earlier temporary reservation and the exceptions from prospecting and occupation for mining under any miner's right that were contained in the 27 October 1981 Order. The revocation changes the legal status of the land, and the trustees must take account of the new statutory regime once the grant is issued.

Matters not addressed in the Act

• No express enforcement regime: the Act does not create express statutory powers, fines or enforcement procedures for breach of the continuation-of-use condition or for other infringements. Enforcement of the use condition and covenants would therefore proceed through ordinary property and contract law mechanisms, or under any statutory regime applicable to Crown grants and covenants, as the legal context provides. The Act itself is silent on remedies.

• No specified duties of the Governor in Council beyond making the grant: s 3(2) mandates issuance of the Crown grant but does not enumerate further duties such as specifying formats for title notation or enforcement steps. The practical conveyancing steps will be undertaken under existing Crown conveyancing procedures.

In short, the Act gives the League trustees the right to hold the parcel subject to a continued-use condition and pre-existing encumbrances and gives the League’s governing body a statutory gatekeeper role over resource authorities affecting the land. The Act imposes ongoing constraints on use rather than criminal or administrative penalties in its text.

The Act contains no express criminal penalties, fines, or statutory enforcement procedures within its four operative sections. Its design is conveyancing and consent-based rather than penal.

Key enforcement-related observations anchored in the text

• No penal provisions: the Act does not include sections creating offences or specifying penalties for breach of the Crown grant conditions, for unauthorised resource activity, or for failure by trustees or the governing body to perform any action. The statutory instrument relies on property-title mechanisms and consent gates rather than on an express enforcement schedule.

• Enforcement through conditions on title: s 3(3) creates the condition that the land continue to be used for an Aboriginal Community Centre and preserves existing covenants, exceptions and restrictions. These conditions and covenants are matters that ordinarily run with the land and would be enforced, if at all, by legal actions available in property law , for example injunctions, specific performance, or damages for breach of covenant , or by mechanisms available to the Crown in enforcing Crown grant conditions. The Act does not specify which of these remedies apply; it leaves the usual applicable law to govern enforcement.

• Resource-authority bar enforced administratively: s 3(4) provides that a lease, licence, permit or other authority under the named resource statutes "shall not be granted" except with the League’s governing body consent and subject to terms they impose. That is an administrative precondition on grant by the authorities administering the Mineral Resources (Sustainable Development) Act 1990 and the Petroleum Act 1998. Enforcement of that precondition is therefore a matter for the resource regulatory agencies: they must not grant an authority absent the required consent. The Act itself does not prescribe an enforcement mechanism to be used if an agency ignores the requirement; the remedy would likely lie in judicial review, declaratory relief or other legal remedies applicable to administrative action, but the Act does not set these out.

• Revocation of prior order: s 3(1) revokes the Order in Council of 27 October 1981 that temporarily reserved the land and excepted it from prospecting and occupation under any miner’s right. The revocation itself is an exercise of executive power; the Act contains no enforcement protocol related to any breach of the earlier Order since it is revoked.

• Practical enforcement via registration and conveyancing: because the grant is to be issued as a Crown grant and is subject to conditions and pre-existing covenants, registration of title and notation of the conditions on title will be central to practical enforcement. The Act does not specify registration mechanics, but the presence of conditions on the Crown grant means that anyone dealing with the land will be put on notice by title documents.

• No statutory oversight body created: the Act does not create a statutory office, inspectorate, tribunal or other body charged with supervising compliance with its conditions. The duty to control resource authorities is given to the governing body of the League, but there is no supplementary public enforcement body created by this Act.

In sum, the Act establishes legal conditions and administrative preconditions; enforcement will therefore arise through existing property law, conveyancing procedures, resource licensing administration, and general public-law mechanisms. Those mechanisms are not detailed inside the Act itself.

The Act intentionally operates in relation to several other statutory regimes. Its text references and, in one instance, overrides provisions of other Acts.

Express interactions in the text

• Land Act 1958: s 3(2) states "Notwithstanding anything to the contrary in the Land Act 1958 but subject to this Act, the Governor in Council shall issue a Crown grant of the Watt Street land to the trustees for the time being of the League." That is an express override or exception to any inconsistent provisions of the Land Act 1958 for this Crown grant. The Crown grant power in this Act therefore takes precedence over contrary Land Act provisions in respect of the Watt Street land.

• Hospitals and Charities Act 1958: the definition of "League" in s 2 links the beneficiary organisation to registration under Part III of the Hospitals and Charities Act 1958. The League’s legal identity is therefore anchored in that registration regime. Any change in the League’s registration status under the Hospitals and Charities Act could affect who is properly described as "the League" for the purposes of this Act, because the Act’s definition depends on that statutory registration.

• Mineral resources and petroleum Acts: s 3(4) refers to the Mineral Resources (Sustainable Development) Act 1990 and the Petroleum Act 1998 as the source statutes under which a lease, licence, permit or other authority might be granted. The Act stipulates that no such authority "shall be granted in respect of any part of the Watt Street land except with the consent of the governing body of the League and subject to such terms and conditions as the governing body of the League thinks fit to impose." Practically, that means the administrative officers and decision-makers operating under those resource statutes must respect the consent requirement in this Act when dealing with the Watt Street land.

• Schedule and plan: the Schedule contains the plan of the land. Under general legislative practice the plan locates the parcel and interacts with land titling and conveyancing law. The delineation in the Schedule determines which statutory interactions apply.

Amendments recorded in the Table of Amendments

• s 3(4) has been amended by subsequent statutes: the Act text records "S. 3(4) amended by Nos 11/2002 s. 3(Sch. 1 item 1), 63/2006 s. 61(Sch. item 4), 6/2009 s. 45." The Table of Amendments lists the Statute Law (Further Revision) Act 2002, the Mineral Resources Development (Sustainable Development) Act 2006 and the Resources Industry Legislation Amendment Act 2009, with respective dates. Those amendments indicate that the resource-consent provision has been the target of later legislative housekeeping or substantive editing, and they constitute the chain of how this Act has been kept current with changes in resource legislation.

ILA and non-operative material

• Interpretation of Legislation Act 1984 (ILA): the Endnotes describe style changes and interpretation effects under the ILA, including that headings, examples, diagrams, notes, punctuation and provision numbers are part of Acts in particular ways. The Endnotes also state that explanatory memoranda, tables of provisions, endnotes, index and other material printed after the Endnotes do not form part of an Act. Those interpretive rules affect how users should read the Act and identify which material is legally operative.

Practical cross-legal implications

• Administrative consistency: resource regulators operating under the Mineral Resources (Sustainable Development) Act 1990 and the Petroleum Act 1998 will need to treat the Watt Street land as a parcel requiring League consent. That creates a cross-act administrative constraint. The Act does not specify procedural detail for effecting consent, meaning that consent processes will be defined by the resource regimes and customary administrative practice, modified by the absolute bar in this Act to grant without consent.

• Property and conveyancing law: because the Crown grant is a conveyance, conveyancing laws, registration, and the Land Act regime will still matter for practical record-keeping and title management, although s 3(2) overrides inconsistent Land Act provisions for the issuance of this grant.

• Continuity of pre-existing encumbrances: by preserving any pre-existing covenants and restrictions, the Act ensures that other private or statutory encumbrances remain effective even after the Crown grant. That affects dealings in the property and interacts with laws governing covenants, easements and other registered burdens.

In short, the Act is narrow in scope but deliberately interacts with property, resource, and registration law by cross-referencing those statutes and by providing an overriding pathway for issuing the Crown grant while preserving existing encumbrances and creating a consent requirement for resource authorities.

The Act itself is short but the text and endnotes document a small amendment history affecting the resource-consent subsection.

Original enactment and commencement

• The Act was assented to on 23 November 1982 and is recorded in the Endnotes as coming into operation on 24 November 1982, Government Gazette 24 November 1982 page 3816. Section 1(2) originally provided commencement by proclamation; the Endnotes supply the operative commencement date.

Recorded amendments to s 3(4)

• The Act text itself records that s 3(4) has been amended: "S. 3(4) amended by Nos 11/2002 s. 3(Sch. 1 item 1), 63/2006 s. 61(Sch. item 4), 6/2009 s. 45." The Table of Amendments expands this into names and dates for the amending Acts:

  • Statute Law (Further Revision) Act 2002, No. 11/2002. Assent date 23 April 2002; commencement of the particular item in Schedule 1 (s 3(Sch. 1 item 1)) on 24 April 2002.

  • Mineral Resources Development (Sustainable Development) Act 2006, No. 63/2006. Assent date 29 August 2006; commencement of the particular item (s 61(Sch. item 4)) on 30 August 2006.

  • Resources Industry Legislation Amendment Act 2009, No. 6/2009. Assent date 3 March 2009; commencement of s 45 on 1 January 2010.

• Those entries indicate that the resource-consent provision has been updated or amended at those times. The 2002 act is labelled "Statute Law (Further Revision) Act 2002", which commonly effects minor textual revisions. The 2006 and 2009 acts relate to resource law reform or amendment and may have adjusted the references or wording in s 3(4) to align with changes in resource legislation; the Act’s own text as reproduced includes the post-amendment version that names the Mineral Resources (Sustainable Development) Act 1990 and the Petroleum Act 1998. The Table of Amendments shows the formal provenance of those edits.

Other interpretive and style changes

• The Endnotes include a broad note about the Interpretation of Legislation Act 1984 (ILA) and style changes authorised under s 54A of the ILA. Those are general statutory housekeeping measures and relate to how headings, examples, notes and punctuation are treated for Acts as from particular dates. The Endnotes also state that explanatory memoranda and other materials printed after Endnotes do not form part of the Act.

No recorded repeals or broader amendments

• Apart from the entries affecting s 3(4), the Act text and Endnotes do not record any other substantive amendments, repeals or re-enactments of the Act as a whole.

Practical significance of the amendment history

• The recorded amendments focus on ensuring that s 3(4) aligns with the evolving statutory framework for mineral and petroleum regulation. Users should note the amending Acts and commencement dates for those items recorded in the Table of Amendments when tracing legislative intent and historical wording, because the present operative text reflects those amendments. The Act’s text includes an inline note of the s 3(4) amendment chain; the Table of Amendments supplies the formal entry points and dates.

In sum, the Act has a restricted amendment history documented in the text, concentrated on the resource-consent subsection and updated through 2009. The Endnotes provide commencement and interpretive context and indicate no further substantive legislative modifications recorded in this document.

The Act and its Endnotes do not record any litigation history. There are no cases cited in the text, no annotated judicial interpretations included in the Endnotes, and no specific entries under a litigation or case history rubric. The Explanatory details section in the Endnotes states "No entries at date of publication," which indicates that the published version does not include an explanatory or litigation history.

Consequences of the absence of recorded litigation

• No precedential clarifications in this source: because the Act’s publication and Endnotes contain no case law, there is no precedent in this document resolving interpretive questions such as the scope of the governing body’s consent, the precise legal effect of the "continue to be used" condition, or how any breach would be remedied in the Victorian courts. Users requiring judicial interpretation will need to search court records or legal databases outside this Act text.

• Practical uncertainties left to general law: where the Act is silent , for example, on remedies for breach of the use condition or the mechanics for recording the Crown grant conditions on title , those matters will be addressed, if at all, by general conveyancing and property law, administrative law applicable to resource authorities, and the practices of relevant land and resources registration offices. The Act itself gives no litigated guidance.

• Amendments but no reported disputes in this source: although s 3(4) has been amended on multiple occasions (as recorded in the Table of Amendments), those amendments are not accompanied in this publication by any note of litigation that prompted them. The changes may reflect statutory housekeeping or alignment with resource-sector reform rather than judicial correction; however, the Act text alone does not specify motive.

What to do if legal questions arise

• For interpretive or enforcement questions that may require judicial resolution , for example, whether a particular proposed non-community-centre use breaches the Crown grant condition or what constitutes valid consent by the governing body under s 3(4) , practitioners will need to consult court records and decisions beyond this Act text. The absence of case material here means the Act is to be read with the general body of Victorian property, contract and administrative law in mind.

In short, this publication records no litigation history for the Act. Any legal uncertainty about interpretation or enforcement must be resolved by reference to external case law and authorities, since none are provided in the Act or Endnotes included here.

This Act is short, but there are a number of legal and practical points that can produce unforeseen consequences if not noticed.

• "Trustees for the time being" phrase: the Crown grant is to be issued to "the trustees for the time being of the League" (s 3(2)). That language means current trustees at the date of grant take title. Absent clear contemporaneous evidence of trusteeship, questions could arise about who has legal capacity to accept, register or deal with the title. The Act does not specify evidentiary or registration formalities, so customary proof of trustee status under the League’s own rules and under conveyancing practice will matter.

• Continued-use condition wording: s 3(3) requires that the land "continue to be used for an Aboriginal Community Centre." That condition is framed in a present-continuing form. Practical questions may arise as to whether ancillary uses compatible with an Aboriginal Community Centre are permitted, whether changes of use require ministerial or other approvals, and whether temporary suspension or leasing for other community-oriented uses would breach the condition. The Act does not define "Aboriginal Community Centre" or specify permitted incidental uses, leaving scope for interpretation under property law.

• Preservation of pre-existing conditions: s 3(3) makes the Crown grant subject to "additional conditions, covenants, exceptions and restrictions (if any) as exist on the day on which this Act comes into operation." Any pre-existing registered covenants or statutory instruments that affect the land survive. Parties assuming the grant conveys unencumbered title should check the Schedule and the historical register: the Act preserves burdens that may constrain use or impose obligations.

• Consent requirement scope and mechanics: s 3(4) prevents resource authorities under the two named Acts from being granted without the governing body’s consent and allows that body to impose "such terms and conditions as the governing body of the League thinks fit to impose." That is broad discretion. But the Act does not prescribe how consent is to be evidenced, how long the consent process should take, whether consent can be refused unreasonably, or whether there are appeal or review pathways. Resource regulators will need to reconcile this Act’s requirement with their administrative procedures. Applicants who fail to obtain consent risk procedural nullity of any purported grant.

• Interaction with registration and Land Act processes: although s 3(2) overrides inconsistent provisions of the Land Act 1958 for the issuance of this particular grant, it does not set out the full procedure for registration, notation of covenants, or administrative steps. Practical conveyancing stages remain necessary. Failure to register the Crown grant correctly or to record the conditions may give rise to future disputes.

• Definition of the League is statutory and contingent: s 2 defines the League by reference to registration under the Hospitals and Charities Act 1958. If the League’s registration is altered, deregistered or if another body purports to act as the League, questions could arise about legitimacy and whether a party is the entity intended by the Act. The Act does not provide transitional rules for changes in legal personality.

• Schedule plan integral despite omission in text version: the Schedule contains the plan of the land. In the version reproduced here the plan is indicated but not shown. However, the Schedule is part of the Act and determines the parcel. Practitioners should obtain the official Gazette or Act version with the plan before engaging in transactions or consent processes.

• No express enforcement or remedies: because the Act contains no specific penalties, administrative power or alternative enforcement modalities, the practical remedy for breach of the condition may require litigation, injunctions, or action under conveyancing law. That introduces delay and potential costs.

• Amendment history focused on s 3(4): s 3(4) has been amended multiple times, as recorded. That suggests the resource-consent language has been sensitive to changes in the resources regulatory regime. Users should verify whether the named resource Acts remain the operative instruments and whether any later amendments to those Acts affect the interaction.

Each of these points flows directly from the Act’s text. They are matters of legal risk and practical friction that users should examine before taking or consenting to actions affecting the Watt Street land.

Compliance under this Act is primarily about proper title management, preserving the specified use, and administering or obtaining consent for resource authorities. The Act does not create an extensive procedural compliance regime, so compliance means steps that align with the Act’s conditions and contemporary conveyancing and administrative practice.

For the League and its trustees

• Establish clear trustee evidence: ensure that documentation identifying the "trustees for the time being of the League" is current, clear and able to be produced to the Lands Title or Crown Land office. Because the Crown grant is to trustees "for the time being" (s 3(2)), practical acceptance and registration of the grant will require authoritative evidence of trusteeship.

• Maintain governing-body records and processes: because the governing body has a statutory consent power over any mineral or petroleum authority under s 3(4), keep formal minutes, policies and decision records for consents, including the terms and conditions imposed. Document the process and the reasons for consent, refusal or conditions imposed to provide clarity to applicants and to support the governing body in the event of dispute.

• Preserve the Aboriginal Community Centre use: take steps to ensure that the land continues to be used as an Aboriginal Community Centre as required by s 3(3). That includes planning and management consistent with that use, and avoiding leases or disposals that would conflict with the condition unless legal advice confirms compatibility. If a proposed ancillary use is contemplated, obtain legal advice on whether it is consistent with "continued" use for an Aboriginal Community Centre, and if necessary, seek formal authorisation or clarification.

• Identify and respect pre-existing covenants: conduct thorough title searches and review historical instruments to identify any "additional conditions, covenants, exceptions and restrictions" that existed at commencement (s 3(3)). Those matters will continue to bind the land and must be complied with.

For resource applicants and regulators

• Obtain governing-body consent before applying: under s 3(4) no lease, licence, permit or other authority under the Mineral Resources (Sustainable Development) Act 1990 or the Petroleum Act 1998 may be granted in respect of any part of the Watt Street land except with the governing body’s consent. Applicants should secure that consent, in writing if possible, and ensure it addresses the terms and conditions the governing body requires.

• Regulatory offices must check for statutory bar: decision-makers under the named resource statutes should include a search and check of the Watt Street land against statutory notations or the Schedule and require production of governing-body consent before making a grant. Administrative files should record the consent and the terms imposed.

For conveyancing and registration

• Ensure title notation of conditions: when the Crown grant is issued, ensure that the continued-use condition and any preserved covenants are properly recorded on title so future purchasers or interested parties are on notice. This supports practical enforceability by making the conditions apparent in registration records.

• Verify the Schedule plan: obtain the official Act Schedule map or the land registry plan that identifies the Watt Street land to confirm the exact parcel boundaries before any transaction or regulatory action.

For governance and risk management

• Keep registration under Hospitals and Charities Act current: because the League is defined by registration under the Hospitals and Charities Act 1958 (s 2), ensure the League maintains whatever registration is required under that Act to avoid disputes as to who is entitled to receive the grant or exercise the governing body’s consent power.

• Legal advice on ambiguous use or consent issues: where doubts arise about whether an intended land use is compatible with the "Aboriginal Community Centre" condition, or about the scope of the governing body’s consenting powers, obtain legal advice. The Act does not define the terms and leaves interpretive questions to property and administrative law.

• Keep records of any dealings: keep contemporaneous records of consents, refusals, leases, licences, or negotiations with resource applicants and any communications with Crown or land agencies. Because the Act provides administrative preconditions without procedural detail, documentary records will be central to resolving disputes.

In short, compliance is practical and documentary: ensure proper trustee identification and registration, preserve and document continued community-centre use, record and respect pre-existing covenants, secure and document governing-body consents for any resource authorities, and ensure title notation so the Act’s conditions are visible to regulators and third parties.
