62 Application to registered Aboriginal party for approval (1) This section applies if one or more registered Aboriginal parties have given notice under section 55 of their intention to evaluate a cultural heritage management plan. (2) The sponsor must apply to each of those registered Aboriginal parties for approval of the plan. (3) An application under subsection (2) must be accompanied by the relevant prescribed fee (if any). S. 62(3A) inserted by No. 11/2016 s. 51. (3A) An application under subsection (2) to more than one registered Aboriginal party is taken to be received by each of the parties on the date on which all of the parties have received the prescribed fee, or if there is no prescribed fee, the application. (4) The sponsor and each registered Aboriginal party referred to in subsection (1) must make every reasonable effort to reach agreement on the matters set out in section 61.
