54 Notice of intention to prepare cultural heritage management plan (1) The sponsor of a cultural heritage management plan must give written notice of the sponsor's intention to prepare the plan— (a) to each relevant registered Aboriginal party; and (b) to the Secretary (unless the Secretary is the sponsor); and S. 54(1)(c) amended by No. 11/2016 s. 45(1). (c) to the owner or occupier of any land within the area to which the plan relates; and S. 54(1)(d) inserted by No. 11/2016 s. 45(2). (d) to any municipal council whose municipal district includes an area to which the plan relates. (2) The sponsor must give the notice referred to in subsection (1) before commencing the preparation of the plan. (3) A notice under this section must— (a) contain the name and contact details of the sponsor; and (b) contain a description of the proposed activity to which the plan relates; and (c) clearly identify the area in respect of which the plan is to be prepared; and S. 54(3)(d) amended by No. 11/2016 s. 45(3). (d) specify the dates within which the plan is proposed to be prepared; and S. 54(3)(e) inserted by No. 11/2016 s. 45(4). (e) be accompanied by the prescribed fee (if any). S. 54(4) inserted by No. 11/2016 s. 45(5). (4) If the proposed activity in the plan is to be carried out in an area for which there is no registered Aboriginal party, a notice under this section may include details of Aboriginal people or Aboriginal groups with whom the sponsor intends to consult.
