49 Plan required if Environment Effects Statement required (1) This section applies if a proponent or other person is required to prepare an Environment Effects Statement under the **Environment Effects Act 1978** in respect of any works. (2) The proponent or other person must, before commencing the works, also prepare a cultural heritage management plan for the area in which the works are to be carried out. (3) In this section— ***Environment Effects Statement*** and ***proponent*** have the same meanings as in the **Environment Effects Act 1978**; ***works*** includes ***public works*** within the meaning of the **Environment Effects Act 1978**.
