178 Seizure of Aboriginal ancestral remains or object (1) This section applies if— S. 178(1)(a) amended by No. 11/2016 s. 119(2). (a) an authorised officer or Aboriginal heritage officer seizes human remains or an object under this Act; and S. 178(1)(b) substituted by No. 11/2016 s. 119(3). (b) the authorised officer or Aboriginal heritage officer believes that the human remains are Aboriginal ancestral remains or that the object is an Aboriginal object. S. 178(2) amended by No. 11/2016 s. 119(4). (2) The authorised officer or Aboriginal heritage officer must ensure that, within 7 days after the seizure of the human remains or object, the human remains or object are transferred into the custody of the Secretary. S. 178(3) amended by No. 11/2016 s. 119(5). (3) If the human remains transferred to the Secretary under this section are Aboriginal ancestral remains, the Secretary must deal with the human remains in accordance with Part 2. S. 178(4) amended by No. 11/2016 s. 119(6). (4) If human remains or an object transferred to the Secretary under this section are not Aboriginal ancestral remains or an Aboriginal object, the Secretary must ensure that the human remains or the object are returned to the person from whom they were seized as soon as practicable.
