174 Announcement before entry S. 174(1) amended by No. 11/2016 s. 115(1). (1) Before executing a search warrant, the authorisedofficer named in the warrant must— (a) announce that he or she is authorised by the warrant to enter the place; and (b) give any person at the place an opportunity to allow entry to the place. S. 174(2) amended by No. 11/2016 s. 115(2). (2) The authorisedofficer need not comply with subsection (1) if he or she believes on reasonable grounds that immediate entry to the place is required to ensure— (a) the safety of any person; or (b) that the effective execution of the search warrant is not frustrated.
