112 What alternative dispute resolution includes (1) Alternative dispute resolution under this Subdivision includes preliminary assistance in dispute resolution, such as the giving of advice designed to ensure that— (a) the parties are fully aware of their rights and obligations; and (b) there is full and open communication between the parties concerning the dispute. (2) In this Subdivision— (a) a reference to alternative dispute resolution includes a reference to mediation; and (b) a reference to a person conducting alternative dispute resolution includes a reference to a mediator conducting mediation.
