What it does
This instrument, the A New Tax System (Goods and Services Tax) Adjustment Note Information Requirements Determination 2022, prescribes the information that must appear in an adjustment note issued for the purposes of the A New Tax System (Goods and Services Tax) Act 1999, hereafter the GST Act (s 1, s 3). It commences the day after registration on the Federal Register of Legislation (s 2). The determination applies to all entities issuing adjustment notes for GST Act purposes (s 3).
Mechanically, the determination does five things. First, it sets a mandatory content list for adjustment notes that are not recipient created adjustment notes (subsection 4(1)). Those items include a statement that the document is an adjustment note and the effect of the adjustment, identity of the supplier including ABN, conditional identity of a recipient (and ABN) where particular thresholds are met, the issue date, a brief reason for the adjustment, the amount of the adjustment to the GST payable (unless the alternative method in subsection 4(3) is used), and, where applicable, the difference between prices before and after the adjustment event (subparagraph 4(1)(g)). Second, it sets a parallel but distinct content list for recipient created adjustment notes (subsection 4(2)), which explicitly requires the recipient’s identity including ABN in all cases where a recipient created adjustment note is used. Third, it provides an alternative method for stating the GST amount where the GST payable equals 1/11th of the price, allowing a specific statement to be used instead of a calculated GST figure (subsection 4(3)). Fourth, it permits certain documents that lack particular items to nonetheless satisfy the GST Act paragraph 29-75(1)(c) where the missing information can be clearly ascertained from other documents given by the issuer to the recipient (subsection 4(4)). Fifth, it addresses multiple adjustments in a single document, permitting consolidated presentation so long as totals for each type of adjustment and the net total of price differences can be clearly ascertained (subsection 4(5)).
