What it does
The A New Tax System (Goods and Services Tax) Act 1999 establishes the GST regime. GST is payable on taxable supplies and taxable importations (s 7-1(1), s 9-40, s 13-15). Input tax credits arise on creditable acquisitions and creditable importations (s 7-1(2), s 11-20, s 15-15). Net amounts for each tax period are calculated by offsetting GST against input tax credits, with adjustments applied (s 7-5, s 17-5). The Act binds the Crown in right of the States, the ACT and the NT but does not expose the Crown to prosecution (s 1-4). Administration, collection and recovery are governed by Schedule 1 to the Taxation Administration Act 1953 (s 2-30).
Division 38 (Subdivisions 38-A to 38-T) classifies specified supplies as GST-free, including food meeting s 38-4 and s 38-2 criteria (subject to s 38-3 exclusions and Schedule 1/Schedule 2), medical and other health services under ss 38-7, 38-10, 38-15, 38-20, 38-25, 38-30, 38-38, 38-40, 38-45, 38-47, 38-50, 38-55 to 38-60, education courses and related supplies under ss 38-85 to 38-110, child care under Subdivision 38-D, exports and related transport/insurance under s 38-185 and Subdivision 38-K (ss 38-355, 38-360), religious services under Subdivision 38-F, charity supplies under Subdivision 38-G, water/sewerage/drainage under Subdivision 38-I, going concerns under s 38-325, precious metal under s 38-385, and other categories including NDIS supports, farm land, disabled veterans’ cars and inbound intangible consumer supplies under ministerial determinations. Division 40 classifies financial supplies, residential premises (ss 40-35, 40-65, 40-70, 40-75), precious metal (s 40-100), school tuckshop food (s 40-130) and fund-raising events (s 40-160) as input taxed. Division 42 treats specified Schedule 4 importations and unaltered returns as non-taxable.
Divisions 48-63, 84-87, 90, 93, 96, 99-102, 105, 108, 110-113 and 57-58 impose special rules that modify basic GST treatment for groups, branches, offshore supplies, insurance, long-term accommodation, amalgamations, deposits, vouchers, lay-bys, debt satisfaction, goods in bond, tax-related transactions and reimbursements. Divisions 69 to 113 establish special rules modifying the core GST treatment of acquisitions, supplies and adjustments, including denial or limitation of input tax credits for non-deductible expenses, reduced credit acquisitions for financial supplies, margin-scheme supplies of real property, insurance and compulsory third-party settlements, reverse-charge or modified treatment for offshore supplies, associates, non-residents and vouchers.
