What it does
This determination prescribes the precise circumstances in which days in a person’s newborn benefit period (NBS period) are to be excluded from adding a newborn supplement amount or a Newborn Upfront Payment (NBUP) under the A New Tax System (Family Assistance) Act 1999 (the Act). Mechanically, the instrument does two things.
First, clause 5 says the circumstances prescribed for the purposes of subclause 35A(11) of Schedule 1 to the Act are those set out in Schedule 1 to the determination. Schedule 1 is a table of 17 items that specify combinations of facts , relationship status (members of the same couple), the timing and duration of other persons’ NBS periods, whether an amount of newborn supplement has been added to another person’s Part A rate for 13 weeks or for less than 13 weeks, and whether parental leave pay has been payable to a third person for a flexible PPL day , and, for each combination, prescribes which days in the individual’s NBS period an amount of newborn supplement must not be added (that is, the days to be excluded). The table frequently uses 13 weeks (expressed as 91 days) and arithmetic differences between 91 and other day-counts to set exclusion windows.
Second, clause 6 prescribes the circumstances for the purposes of subsection 58AA(3) of the Act (NBUP entitlement exclusion). Those circumstances are set out in Schedule 2, a three-item table that specifies when a day in an individual’s NBS period should be excluded from NBUP entitlement because another person has already received NBUP in relation to the same Family Tax Benefit (FTB) child and particular couple-status and timing conditions obtain.
The instrument starts on 1 April 2024 (clause 2) and is made by the Minister for Social Services under subclause 35A(12) of Schedule 1 to the Act (clause 3). It defines key terms in clause 4 by reference to the Act and to the Paid Parental Leave Act 2010: “Act” (the Family Assistance Act), “NBS period” (the day or days in which subclause 35A(2), (5) or (7) applies), “NBUP” (amount paid under s 58AA), “parental leave pay” and “flexible PPL day” (each as in the Paid Parental Leave Act 2010).
