#### 42 Determination of “normal circumstances” entitlement claim If: (a) the claim is one for payment of a stillborn baby payment in normal circumstances; and (b) the Secretary is satisfied that the claimant is eligible for a stillborn baby payment in accordance with Subdivision A of Division 2 of Part 3 of the Family Assistance Act in respect of the child to whom the claim relates; the Secretary must determine that the claimant is entitled to be paid the stillborn baby payment and must determine the amount of the payment that the claimant is entitled to be paid.
