CITATION Zuo & Anor v Municipal Building Surveyor for the Whitehorse City Council [2025] VBAB 126
Having considered all the submissions and information placed before it, the Building Appeals Board (BAB) determines that:
_______________________ ________________________
For the Applicant In person and Mr T Huang (interpreter)
(a) the rainwater tank overflow pipe not being connected to divert the captured stormwater to the allotment's legal point of discharge;
(b) the dwelling's rear polycarbonate roof not being fitted with functional guttering and downpipes to divert the captured stormwater to the allotment's legal point of discharge; and
(c) the outbuilding in the rear of the property not being fitted with functional guttering and downpipes to divert the captured stormwater to the allotment's legal point of discharge
Building work has been carried out on the building/land/ in contravention of the Building Regulations 2018.
The appeal lodged in relation to this matter by the owner is outside the prescribed appeal period of 30 days under Regulation 271 of the Building Regulations 2018. The Building Notice was issued on 17 December 2024, with the appeal being lodged on 07 May 2025, soe 112 days beyond the appeal period.
The prescribed appeal period is clearly denoted on the Building Appeals Board application form and the notes section of the subject Building Notice.[1]
(a) The Building Notice was issued on the basis that:
Building work has been carried out on the building/land/ in contravention of the Building Regulations 2018.
(b) 'Building work'[2] and 'plumbing work_[3]_' are differentiated under the Building Act:
(c) The Building Notice expressly lists the following alleged 'building work' that is in contravention of the Building Regulations:
(i) The rainwater tank overflow pipe has not been connected and divert the captured stormwater to the allotment's legal point of discharge, in contravention to Part 7.4 and Part 3.3 and H2D2 of the Building Code of Australia and Regulation 133 of the Building Regulations 2018; and
(ii) The dwelling's rear polycarbonate roof has not been fitted with functional guttering and downpipes to divert the captured stormwater to the allotment's legal point of discharge, in contravention to Part 7.4 and Part 3.3 and H2D2 of the Building Code of Australia and Regulation 133 of the Building Regulations 2018; and
(iii) The outbuilding in the rear of the property has not been fitted with functional guttering and downpipes to divert the captured stormwater to the allotment's legal point of discharge, in contravention to Part 7.4 and Part 3.3 and H2D2 of the Building Code of Australia and Regulation 133 of the Building Regulations 2018;
(d) We are of the view (without making any finding) that the above works referenced in the Building Notice are not 'building work' but in fact 'plumbing work', as these works involve stormwater and roof plumbing works.
