Introduction
- This is an appeal under s 80(2) of the Civil and Administrative Tribunal Act 2013 (NSW) ("the NCAT Act") from a decision of the Guardianship Division of the Tribunal made on 3 October 2019 in which the Tribunal made a financial management order appointing the NSW Trustee and Guardian (TAG) to manage the estate of ZOF. The Tribunal's order excluded ZOF's Centrelink income from being subject to management.
- We have concluded that the appeal should be dealt with by way of a new hearing under s 80(3) of the NCAT Act, because we consider one of the grounds of appeal warrants a new hearing.
