- The application of general principle requires that there be an adjustment to represent a discount on account of these factors in order to pay due regard to the vagaries and vicissitudes of litigation. All these factors involve risk and chance that are required to be accounted for in the form of a discount to reflect the chance that the litigation may not have proceeded as planned : Johnson v Perez [1988] HCA 64; (1988) 166 CLR 351.
- In determining the appropriate percentage adjustment to reflect these matters I have had regard to the seasoned expert opinions of Mr O'Halloran and Mr King SC, as well as drawing upon my own experience of such factors when practicing in this area not so long ago.
