Original judgment source is linked above.
The applicant, Ms Wombat, sought a review of a decision made by the Department of Human Services - Central Assessment Unit to issue a notice prohibiting her from working with children. The prohibition notice was issued on the basis of a robbery with violence conviction which is a presumptive disqualification offence under s 26A of the Child Safety (Prohibited Persons) Act. Ms Wombat did not provide submissions to the Department of Human Services to rebut this presumption.
Ms Wombat submitted to the Tribunal that when she had been convicted of the disqualifying offence she was aged 15 and was grieving the recent loss of her father with no support from her family. During this time Ms Wombat got involved with drugs and alcohol, and had been subject to sexual abuse. Since this conviction, Ms Wombat received some support and counselling, has reconciled with the victim of her offending, commenced TAFE studies, gained employment, and now supports her 7 year old daughter.
The respondent submitted that Ms Wombat had not displaced the presumption under s 26A. In the alternative, if the Tribunal concluded that Ms Wombat had rebutted the presumption, then the matter ought to be referred back to the Department to reconsider, as there were other matters which the Department might consider aside from the presumptive disqualification offence.
The Tribunal accepted Ms Wombat's submissions regarding the circumstances surrounding the offence and set aside the original decision but accepted the respondent's submission that the matter should be remitted to the Department for reconsideration.
The Tribunal sets aside the decision under review and refers the decision back to Department of Human Services - Central Assessment Unit for reconsideration.
