Wise v Law Institute of Victoria Limited (Legal Practice) [2012] VCAT 1518
Mr. .P. Riordan, SC and Ms E. Tueno of Counsel (3 September 2012)
The role of the Tribunal on an application for review
What responsibility does Mr Wise have for the matters admitted?
'It is no answer for the appellant to claim that he left the conduct of the financial affairs of the firm to his partner. It would be no answer generally and certainly not in this case where the appellant neglected his responsibilities despite warnings that all was not well.' [4]
'....a director, whatever his or her background, has a duty greater than that of simply representing a particular field of experience or expertise. A director is not relieved of the duty to pay attention to the company's affairs which might reasonably be expected to attract inquiry, even outside the area of the director's expertise.'[5]
Is Mr Wise a fit and proper person to hold a practising certificate?
Should there be a separate restriction on Mr Wise obtaining a practising certificate authorising receipt of trust monies?
