REASONS FOR DECISION
- This is an appeal by a tenant against orders of the Tribunal ordering her to pay the landlord the sum of $2,627 for unpaid rent and various fees and charges relating to the tenancy and its termination (in proceedings RT 20/35864), and also an appeal by the tenant against an order that the landlord is to pay her $479 being a refund of electricity charges (in proceedings RT 20/45683).
- For the reasons that follow the appeal must be dismissed.
Background
- The parties had entered into a residential tenancy lease for premises at Bilambil Heights, NSW.
- Disputes arose between them and multiple proceedings have been commenced in the Tribunal.
- A number of proceedings (being proceedings RT 20/04765, 20/09345, 20/10903 and 20/11937) between the parties were heard together and determined on 30 March 2020. A number of orders were made.
- Order 2 of the Orders made in those proceedings was: "The landlord is ordered to comply with its obligations under section 40 of the Act to pay all charges incurred since 21 January 2020 for the supply of water and electricity to the premises, until the premises are separately metered.
