Introduction
- The appellant, Mr Maurice Clifford Westerweller, appeals from two decisions of the Consumer and Commercial Division of the Tribunal (Tribunal) in matter SC 22/10623.
- The first decision was published on 8 November 2022 (Primary Decision). For the reasons stated in the Tribunal's reasons for decision, the application was dismissed.
- The second decision was published on 3 January 2023. That decision dealt with the costs of the application (Costs Decision). The Tribunal ordered the appellant to pay the respondent's costs.
- The appeal of the Primary Decision was not filed within the 28 day time limit. The appellant therefore requires an extension of time for that appeal.
- We have considered the appeals separately and have considered the merits of the appeal of the Primary Decision in the context of determining the application for an extension of time.
- For the following reasons we have decided that: 1. In so far as the appeal relates to the Primary Decision: 1. the application to extend the time for filing the Notice of Appeal is refused; and 2. the appeal is otherwise dismissed. 1. In so far as the appeal relates to the Costs Decision: 1. the application for leave to appeal is refused; and 2. the appeal is otherwise dismissed.
