- In these proceedings the plaintiff Westcoast Clothing Company Pty Ltd ("Westcoast") seeks damages from the defendants for losses alleged to have arisen out of the dismissal of proceedings that it had brought in the Supreme Court of Western Australia against the Sail America Foundation for International Understanding ("Sail America"). The Western Australian proceedings were commenced on 20 February 1987 and dismissed on 7 September 1994. They concerned a claim for damages for alleged breach of a contract between Westcoast and Sail America and for alleged fraudulent misrepresentations by Sail America.
