(1) In a civil proceeding, the court must find the case of a party proved if it is satisfied that the case has been proved on the balance of probabilities.
(2) Without limiting the matters that the court may take into account in deciding whether it is so satisfied, it is to take into account:
(a) the nature of the cause of action or defence; and
(b) the nature of the subject - matter of the proceeding; and
(c) the gravity of the matters alleged.
(a) On 16 May 2022 at 4pm, the father bent W's hand backwards, grabbed her right wrist and pressed her thumb into the inside of her wrist, causing bruising.
(b) On 28 May 2022, the father jumped on W five times whilst she was lying in her bed, including on her ankles, causing bruising.
(c) On 28 May 2022, the father kicked W in the shin and dug his toenails into her skin.
(d) On 28 May 2022, whilst at the front door, W stepped on the father's foot, causing him to say, 'you'd better not do that again' and then kicking W's shin with his shoes on.
(e) On 29 May 2022, the father came over to W who was seated on the couch and moved her legs to sit down by placing her legs over his and pressing two fingers into her leg below her knee.
(f) At some point during the weekend of 28 and 29 May 2022, the father hit W on the back of her head.
(g) At some point during the weekend of 28 and 29 May 2022, and whilst W was seated on the couch, the father hit W using a closed fist on her hip.
(h) At some point post-separation, and when the father still resided at the Town R property, he grabbed Y with one hand on her arm and the other hand on her clothing near her lower back and threw her across the room 'in a sweeping motion'.
(a) During the relationship, the father pressured her into having sexual intercourse with him;
(b) The father verbally abused her daily throughout the relationship, at times in the presence of the children, with words to the effect, 'You are a pig of a woman', '[Ms Wasley] wants it her way. I have nothing to say to you', 'Men aren't your friends', 'It's [Ms Wasley]'s way or the highway', and 'You can't be told';[46]
(c) That the father was financially controlling during the marriage by not allowing her to see an accountant to complete her tax returns and that he refused to provide her with money when she requested it, instead saying to her to figure it out;
(d) That the father was controlling of the mother's friendships and that the father forbade her and the children from having visitors over and that as a result, the children never had playdates;
(e) On one occasion during the marriage, the father got angry whilst driving and said words to the effect, 'I will drive this car into a telegraph pole and take us both out'. Both Ms J and Ms M were in the car at the time, and 'maybe [W]'.[47]
(f) That the father would become aggressive when frustrated, and would punch walls, the kitchen bench and the floor;[48]
(g) When the children woke up throughout the night and came to the parties' room, the father screamed at them with words like, 'Go fucken to sleep. What the fuck are you doing here';[49]
(h) The father called X derogatory names like 'ponce' and 'poofta man', including calling him a 'ponce' whenever he cried;[50]
(i) The father struck the children with different objects like toys, towels, clothing or 'anything he could grab'. The father hit the children on the back of their heads and would hit X on the back of his knee, head and shoulders;[51] and
(j) When the children injured themselves, the father would become angry and say words to the effect, 'You're a fucking joke', 'This is fucking bullshit', 'I'm sick of this fucking shit', 'Fuck you all', 'Fuck this shit' and 'Kill me now'. The children would try and hide their injuries from the father.[52]
[the father] often joked about being a [public servant] which meant that he knows how to hide bodies. I was frightened by this comment.
On one occasion (I do not recall the year), the children said to me words to the effect of "Daddy tried killing your plants. He was watering the plants with his beer".
The Mother's Allegations Concerning the Father's Mental Health
Incident Where Y is Allegedly Thrown Across the Room
... with one hand on her clothing near her lower back area, and the other hand on her upper back, he was holding her in a position that her face and tummy were facing and parallel to the ground.[65]
I saw [Mr Wasley] raise his elbow up, clenched his fist and imitated a punch on the kitchen bench. He held his fist there, like he was pushing into the bench and shaking his arm, before releasing it, like he was doing that out of anger.[69]
(a) On the mother's case, the father as an angry and disproportionate reaction to Y jumping on the furniture threw the child across the room, in the presence of the mother. If this occurred in the manner described by the mother, it was a significant act of violence: namely, to be throwing a small child of less than 5 years of age, across the room in a fit of anger. The mother makes no suggestion that Y was ever thrown against a wall. The mother says that Y had carpet burn as a result;
(b) On Y's account to Ms E, the father either threw her across the room or threw her against a wall;
(c) On Y's account to Ms C, the father threw her around in the lounge room and she got carpet burn; and
(d) On Y's account to the Police, the father threw her in a sweeping motion across the room.
Incident Alleged by W Following the Weekend of 14 and 15 May 2022
... around and then like wherever just like last night he was like slamming all the cupboards and like [at time stamp 0.08 [W] starts twirling in her chair] yelling when [Z] was in bed, and like [at 0.11 she stops twirling] rousing and like doing one of those things and grinds his teeth and then like he just comes up and then like when he yells I'm scared around him because like he just yells and starts swearing and get vicious because like he started grabbing [Y] up the stairs like recently and then like [at 0.30 she starts twirling again in her chair] last night when he was putting me to bed I had [at 0.34 she stops twirling] two layers of blankets and he just chucked it on my face like in a big blob [at 0.38 [W] is observed with a slight smile on her face] and then he slams the door [at 0.40 [W] is smiling and twirling chair] and then he goes to [X] like in a boom (?) and like all night all I could hear was him snoring and huffing and puffing and walking around stomping [At the end of the video [W] is observed to smile while looking directly at the camera and to stop twirling].
[matters observed by the Court at time stamps as indicated]
... and another time "he got really made and I think he was drunk as well and he grabbed my wrist and he stuck his thumb in and I got a big bruise."
Incident Alleged by W on 30 May 2022 and W's Admission to Hospital
So this morning he came in my room to wake me up turned off my nigh light and open the blinds, but he had jumped on me a few times and harshly rubbing my back and I said stop a few time and then he stomped on the ground and I thought he was gonna hut me. Next when we were going to [sports match], [X]'s [sports] he saw his mate, so he had talked to the Mate, and he had he's son. The son had a [sports] ball so he was playing around with it everyone started playing with it and incept me so I said can I had the ball dad ignore me. So I go to [Z] and said can I have the ball she said yes so I give it to [Y] and I said hey dad can I have the ball everyone ignored me. You know that Dad's manager she runs out to the field he says come on. He will just follow then he leaves the door Open for [Y] and [Z] and shut it on me, and I had feeling sad (sad emoji face) for the weekend and gets mad (mad emoji face).
[errors in original]
met with [W]. [W] brought a notebook to her, in which she had written some things about her dad that she wanted to tell me. It began saying "my dad hurts me and it makes me sad". See attachment for further.
I asked [W] to give me an example of when this has happened:
"I was sitting on the couch and dad came next to me and slapped his hand on my leg" She showed a bruise on her left leg just below the knee. She stated "I told him to stop and he didn't stop. When I go to bed, he comes in and watches me sleep."
"When he gets made he starts stomping and yelling".
"Yesterday morning he jumped on me 5 times" (clarified that she was lying in bed and he did this in a lying down position). "Then he harshly rubbed my back with his knuckles. Then he jumped with his feet and landed on my ankle and I have a bruise from it." (Pale bruise noted on ankle. No visible marks on back).
"I have bruises on my shin from where he kicked me. We went to the park and [X] needed to go home and when we got home I bumped into dad and he said you'd better watch it then he kicked my legs." When I told him to stop he called me "baby" and this made me uncomfortable.
[W] reported that she had a sore stomach "I feel like I have bruises inside my stomach" which she attributed to when he jumped on her. She reported that this was the second time this has happened and another time "he got really mad and I think he was drunk as well and he grabbed my wrist and he stuck his thumb in and I got a big bruise."
[W] reported that she had headaches from him hitting her on the head with her sister's home reader. She reported that this was making it hard for her to concentrate. [W] agreed with me calling mum with her present. P/call to mum. Advised that [W] was reporting that her dad had hurt her and that she was describing stomach pain and headaches resulting from this. Advised mum that I am not qualified to assess for significant injury and encouraged her to seek medical review. Mum agreed to same and collected [W] to take her for medical review.[103]
([W]'s notebook was not in evidence)
(a) Not only did W not tell the father about her injuries, but he did not see the injuries on 30 May 2022, although she had bruises on her legs from the Thursday prior when the children came into his care;
(b) He made no observations on 30 May 2022, of W being on FaceTime with anybody, crying, or locking herself in the bathroom. The father said that she did take a shower at some point but was not sure at what time;
(c) When he placed his hands on her torso in the morning of 30 May 2022, he was standing next to the bed facing W. He added that his knees would have almost been hitting the bedframe in terms of proximity to the bed. When asked why it was necessary to place both hands on W's torso, the father said 'It was, I didn't, it was just like "Come on [W] you have to get up", there was sort of a little bit of a sense of urgency but it was gently'. The father agreed that when he lent down he had his hands on W's torso, but disagreed that his weight when bending over would have been in his hands, saying 'No, I took the weight in my legs';
(d) Both of his feet left the ground when he jumped, but he disagreed that his arms on W's torso would have been carrying the weight as he 'didn't jump at that moment';
(e) The father said his shin knocked W but that he does not know where it would have knocked her as she was under the doona; and
(f) There was a gap between himself and W when he lay next to her, and that he did not jump on, crush, or lay on top of W.
The Mother's Moving Truck and ADVO Against the Father for the Mother's Protection
Not going to be one of those mums who says nobody listened to me and now my kids are gone. Regardless of the fucking criminal outcome, this shit happened - it's not just what happened to [W]. I've gone through years of shit with him, I'm not coming forward, it's not about me. I don't want to focus on me, I know what he's done, he's not fucking well.
Observations of the Children with each of the Parents
I note that a combination of the service offered by [F Centre] alongside supervised time, and the children's ongoing engagement with [Ms E] may be appropriate, however, I am also mindful of minimising the clinicians involved, the cost, and the need for [Ms Wasley] to be taking the children to numerous appointments. It is likely that engaging with [F Centre] only would address the issues, however, I accept that the children already have a strong therapeutic alliance with [Ms E].[196]
Additional commentary from Ms C during her oral evidence
Did the Father engage in acts of family violence?
Does the Father pose an Unacceptable Risk of Harm to the Children?
On the morning of Monday 30th of May 2022, [Mr Wasley] sent me a text message to see if we were still going ahead with the 4pm changeover, or whether I wanted him to stay and to drop the children to school on Tuesday morning. I agreed to this as it assisted me in getting a pink slip for the [...] motor vehicle. Therefore, I stayed an extra night at my mother's place. I also did not want to argue with [Mr Wasley] as I did not want him to become angry.[203]
