s.210 - Application for approval of a variation of an enterprise agreement
Visy Industries Holdings Pty Ltd T/A Visy Logistics Pty Ltd
VISY YATALA GLASS TRANSPORT AND WAREHOUSE AGREEMENT 2024
Application for variation of the Visy Yatala Glass Transport and Warehouse Agreement 2024
[1] Visy Industries Holdings Pty Ltd trading as Visy Logistics Pty Ltd has applied for approval of a variation (Variation) to the Visy Yatala Glass Transport and Warehouse Agreement 2024 (Agreement). The application is made under section 210 of the Fair Work Act 2009 (Act).
[2] The effect of the Variation is to expand the coverage of the Agreement to employees working at a site in Stapylton, Queensland.
[3] The Agreement covers the Transport Workers' Union of Australia (TWU). The TWU informed the Commission that it did not wish to advise whether it supports or opposes approval of the Variation, or whether it disagreed with the contents of the declaration that Visy filed in support of the application.
[4] Having regard to the material in the application and accompanying declaration, I am satisfied that each of the requirements of sections 210 and 211 of the Act as are relevant to the application for approval of the Variation have been met.
[5] The Variation is approved. The Variation takes effect from the date of this decision.
[6] The consolidated version of the Agreement, as varied, is attached to this decision.
