- These proceedings concern the valuation for rating purposes of five sites owned by Vicgrain Assets Pty Ltd, the Objector named above ("Vicgrain Assets"). The proceedings arise from the sale by the Victorian Government, as part of its privatisation program, of the grain handling business and assets of the Grain Elevators Board ("GEB") established under the Grain Elevators Act 1934 ("the Grain Elevators Act"). The agreement for the sale appears as Schedule 1 of the Grain Handling and Storage Act 1995 ("the Grain Act"). Prior to the sale, the fixed assets of the GEB had been transferred to Vicgrain Assets, then a wholly owned subsidiary of the GEB. The purchaser, Vicgrain Operations Limited, now Vicgrain Limited, acquired all of the business and assets of the GEB, including all of the shares in VicGrain Assets, the sale taking effect from 1 July 1995. The price paid for those assets was $51 million. Since then the business, still employing those assets, has been operated by Vicgrain Limited.
