Judgment
- COMMISSIONER: The applicant appeals Hurstville City Council's refusal of Development Application DA2014/0112 for the demolition of two existing structures, consolidation of two lots and construction of a residential flat building with affordable rental housing at 2 and 4 Morotai Avenue, Riverwood.
- At the time the applicant lodged the Class 1 appeal with the Court, the council had yet to determine the application. Council subsequently refused the application on 5 November 2014.
- The appeal is made pursuant to s 97(1) of the Environmental Planning and Assessment Act 1979 (the Act).
- In December 2014 the Registrar granted the applicant leave to rely on amended plans. At the hearing, the applicant was granted leave to rely on further amended plans.
