Application to deal with contraventions involving dismissal - jurisdictional objection dismissed
I refer to the above matter, which has been allocated to Deputy President Lake. The Deputy President is required to determine the jurisdictional objection prior to holding a conference.
The Deputy President notes the Respondent has raised the following objection:
The Respondent contends that the cessation of Mr Tsheden's employment was not a dismissal but rather resulted from a series of ongoing behavioural issues.
The Deputy President notes that dismissal under s.386 is an objective assessment. The reasons for the termination of employment are not relevant in assessing whether a dismissal has occurred in fact.
The Deputy President further notes that the Form F8As raise an objection on the basis of no employment relationship. However, the response in part 2.1 of the form refers to the Applicant's "employment".
The Respondent is to advise by close of business, 7 November 2025, whether they are continuing to press a jurisdictional objection and, if so, on what basis. The Deputy President is minded to determine the jurisdictional objections, if pressed, on the papers.
(a) the person's employment with his or her employer has been terminated on the employer's initiative; or
(b) the person has resigned from his or her employment, but was forced to do so because of conduct, or a course of conduct, engaged in by his or her employer.
The cumulative effect of the Applicant's performance deficiencies, disruptive conduct, and unauthorised actions led to management's decision to end the employment relationship. This decision was a consequence of the Applicant's actions and performance, rather than a dismissal in the conventional sense.
On 22/8/25 around 1.30pm, it was observed that you accessed customer and workshop records other company system and attempted to take photographs of this information. This behaviour is unacceptable and represents a serious breach of confidentiality, privacy, and trust.
Customer and workshop records contain sensitive information. Copying or attempting to remove such data without authorisation is a serious matter under workplace law and privacy obligations in Queensland. These actions put both our customers and the business at significant risk.
Given the seriousness of this incident, management has made the decision that this will be your final week of employment. Your last working day will be 23/08/25. You are expected to complete your duties professionally during this period.
The matter will be programmed for a conciliation conference in accordance with s.368 of the Act.
