[14] Having taken into account the considerations in s.319(3) of the Act, I order that:

1. Pursuant to s.319(1)(b) of the Fair Work Act 2009 (Cth), the Commission orders that the UGL Rail Pty Ltd Nebo Enterprise Agreement 2025 [AE531640, PR795249] will cover non-transferring employees who:

(a) are employed by UGL RS Pty Ltd;

(b) who perform, or are likely to perform, transferring work within the scope of the UGL Rail Pty Ltd Nebo Enterprise Agreement 2025 [AE531640, PR795249].

1. Pursuant to s.319(4) of the Fair Work Act 2009 (Cth), order 1 comes into effect at the later of:

(a) the time when the non-transferring employees start to perform the transferring work for UGL RS Pty Ltd; or

(b) the date of this order.
