(j) Any other material the Tribunal considers relevant
while physical contact with children is inadvisable and should be closely scrutinised, in my view, placing your hand on a child's stomach or chest to calm them falls outside the range of permissible physical contact even allowing for the occasional excesses to which teachers may resort.[58]
Section 108(2)(a) - The 'reasonable parent test'
A reasonable person would not approach the task with a closed mind thinking that once a person has offended, he or she can never be redeemed. The reasonable person, however, would not put aside all scepticism and reasonable caution in this most difficult area some over optimistic attempt to facilitate rehabilitation.[68]
requires the tribunal to make a rational, objective and evidence-based assessment of the nature and degree of the risk (if any) which giving the notice would pose in the given facts and circumstances. The concept of 'unjustifiable risk' incorporates notions of weighing, balancing and proportionality. Taking into account the considerations specified in s 13(2), the seriousness of the potential harm must be assessed against the probability of it occurring. The tribunal's risk assessment must be an evaluative judgment about whether giving the notice would not pose an 'unjustifiable risk' to the safety of children...[75]
