If a development meets standard A3, A4, A5, A6, A9, A9.1, A10, A11, A12, A13, A14, A15, A16, A17 or A20, it is deemed to meet the objective for that standard.
Where standard A3, A4, A5, A6, A9, A9.1, A10, A11, A12, A13, A14, A15, A16, A17 or A20 is met the decision guidelines for that standard do not apply to the application.
Building height objective
To ensure that the height of buildings respects the existing or preferred neighbourhood character.
Standard A4
The maximum building height should not exceed the maximum height specified in the zone, schedule to the zone or an overlay that applies to the land.
If no maximum height is specified in the zone, schedule to the zone or an overlay, the maximum building height should not exceed 9 metres, unless the slope of the natural ground level at any cross section wider than 8 metres of the site of the building is 2.5 degrees or more, in which case the maximum building height should not exceed 10 metres.
WILL THERE BE ANY UNREASONABLE OFF-SITE AMENITY IMPACTS?
IS AN APPROPRIATE LEVEL OF INTERNAL AMENITY PROVIDED?
DOES THE PROPOSAL APPROPRIATELY PROVIDE FOR CAR PARKING?
140.1 The existing dwelling on site has no crossover or onsite parking, the replacement dwelling would maintain this arrangement, albeit with two additional bedrooms. The single dwelling is not expected to generate significant increases to parking demand when compared to existing conditions. > > 140.2 There is an adequate amount of street parking within the immediate vicinity as identified in the car parking demand assessment Attachment 6. > > 140.3 The subject site is located within the PPTN and is proximal to public transport, including
140.4 Given the small lot size (143m2) and the lack of rear access, the feasibility of providing two onsite car spaces on site whilst maintaining a quality design response is questionable. > > 140.5 This part of Pickles Street generally has small front setbacks and no on-site parking, the proposal meets this character without car parking. The introduction of a crossover and a garage to the front façade would likely result in a poorer urban design outcome. > > 140.6 The site is nearby the Bay Street activity centre, however the proposal would not affect the viability of this centre, given its single dwelling scale.
Construct or extend one dwelling on a lot less than 300 square metres.
Reduce (including reduce to zero) the number of car parking spaces required under Clause 52.06-5.
(a) 1.8m fence and clothesline to side setback on ground floor plan to be removed and the inclusion of a solid pedestrian gate with a minimum height of 1.8m to be positioned across E-1, between 2m to 3.5m from the front title boundary.
(b) Rainwater tank on ground floor plan to be noted as connected to toilets
(c) Front fence to be noted as maximum height of 1.5m on ground floor plan and streetscape elevation.
(d) Any modifications required as a result of the Water Sensitive Urban Design response required by Condition No. 7 of this permit.
(e) The removal of the zen garden and no plantings within E-1, and a sealed surface to be provided within E-1.
(f) Show all existing habitable windows and pedestrian gates for 207 Pickles Street along the northern boundary that align with E-1.
(g) Remove the window shroud of the northern window of the study at ground level.
(h) The front fence is to include a sliding gate along the width of E-1 and must be designed to allow stormwater runoff to flow through it.
(a) Demonstrate how the development meets the water quality performance objectives as set out in the Urban Stormwater - Best Practice Environmental Management Guidelines (CSIRO, 1999) or its updated equivalent. This must include:
- Design details of the water sensitive urban design stormwater treatments to be used, including cross-sections and connection to legal point of discharge.
- A STORM report with a score of 100 per cent (%) or greater (or MUSIC modelling for large scale developments).
- A plan showing all stormwater catchment areas, permeable and impermeable areas in square metres (m2).
- A plan illustrating the location of the nominated water sensitive urban design stormwater treatment measures in relation to buildings, sealed surfaces and landscaping areas, with connection notations.
(b) Details of how the water sensitive urban design stormwater treatment measures will be maintained on an on-going basis. This must be demonstrated by providing a maintenance manual including the following information:
- A full list of maintenance tasks.
- The required frequency of each maintenance task (monthly, annually etc.).
- Person responsible for each maintenance task.
Incorporation of Water Sensitive Urban Design Measures
Construction Management Water Sensitive Urban Design
(a) No water containing oil, foam, grease, scum or litter will be discharged to the stormwater drainage system from the site.
(b) All stored wastes are kept in designated areas or covered containers that prevent escape into the stormwater system.
(c) The amount of mud, dirt, sand, soil, clay or stones deposited by vehicles on the abutting roads is minimised when vehicles are leaving the site.
(d) No mud, dirt, sand, soil, clay or stones are washed into, or are allowed to enter the stormwater drainage system.
(e) The site is developed and managed to minimise the risks of stormwater pollution through the contamination of run-off by chemicals, sediments, animal wastes or gross pollutants in accordance with currently accepted best practice.
(a) The development is not started within two (2) years of the issued date of this permit.
(b) The development is not completed within four (4) years of the issued date of this permit.
In accordance with Section 69 of the Planning and Environment Act 1987 (Vic), an application may be submitted to the responsible authority for an extension of the periods referred to in this condition
[1] The submissions and evidence of the parties, any supporting exhibits given at the hearing and the statements of grounds filed have all been considered in the determination of the proceeding. In accordance with the practice of the Tribunal, not all of this material will be cited or referred to in these reasons.
[2] This is the only planning policy relied upon in the applicant's written submissions.
[3] At page 11 of the pdf document, where the written submission concedes that the proposal complies with the 9.0 metre mandatory building height found in the Neighbourhood Residential Zone, which means that it also complies with the 9.0 metre height limit at Standard A4.
