- The plaintiff commenced a proceeding by writ on 10 September 1994 against Petersville Industries Limited in which she claimed damages pursuant to the Wrongs Act 1958 on account of the death of her husband on 14 February 1993. The deceased had been injured at his place of employment on 23 January 1993 and died in hospital three weeks later.
- In January 1995 a Coroners' Inquest began in Melbourne to find the cause of death and the names of parties who caused or contributed to the death. The inquest was adjourned and recommenced in mid May. The Coroner was provided a number of expert's reports into a Giustimex pressure vacuum jacketed cooker (the cooker), owned by the defendant, its lid (the lid) and the control mechanism for operating the lid (the control mechanism).
