s.789FC - Application for an order to stop bullying

Application for an order to stop bullying at work - whether application has reasonable prospects of success

• [1] On 18 August 2025, Ms Rakshita Tikoo applied for an order to stop bullying at work under s.789FC of the Fair Work Act 2009 (the Act). The application was made in relation to Airservices Australia and a person with whom Ms Tikoo interacted while at work in its business.

• [2] Ms Tikoo's employment ceased by way of voluntary redundancy on 19 September 2025. It is not in dispute that Ms Tikoo is no longer at work in the business of Airservices Australia and is no longer interacting with the individual named in the application in any work capacity.

• [3] Although there is a possibility that Ms Tikoo will apply to work again for AirServices after six months, this possibility is speculative. At the present time, the Commission could not make an order to stop bullying at work in the matter and for this reason, Ms Tikoo's application now has no reasonable prospects of success.[1] Of course, if circumstances change and a new risk of bullying emerges, Ms Tikoo can make a further application to the Commission to stop bullying at work.

• [4] The application (AB2025/679) is dismissed under section 587(1)(c) of the Act.
