Pursuant to Section 96(2) of the Environmental Planning and Assessment Act, 1979, amend, Condition Nos. 1, 34 and 43 of Development Consent No. 02/386 issued 24 June 2002 as follows:-
1 a) The development shall be carried out in accordance with plans received by Council on 12 June 2002, numbered Drawing A, B3 Rev A dated 18 February 2004, B4, where amended by Modification Application No. 04/386/01 and plans numbered B5-A-Rev A, B2.2-Rev A, B2.1-Rev A dated 9 December 2003 and B1-A Rev B and C1-Rev B dated 18 February 2004 and by the conditions of the Consent.
(b) The extent of hard paving for the driveway forward of the building line is to be reduced, as shown on Plan B5-A-Rev A dated 9 December 2003.
34 A schedule of finishes and landscape plan must be submitted to Council with the Construction Certificate. The landscape plan is to include the following details:
(a) The location of proposed landscape beds;
(b) A planting plan showing all plant locations. Please note, there is to be a dense planting of trees, shrubs and groundcovers within all the planter beds; and
(c) A plant schedule listing all plants by botanical and common names, total plant numbers and pot sizes.
At least one tree with a mature height of 5 metres is to be provided within the front setback area.
43 The applicant being informed that this approval shall be regarded as being otherwise in accordance with the information and particulars set out and described in the Development Application registered in Council's records as Development Application No. 02/386 dated as 14 February 2002 and Modification Application No. 02/386/01 dated 17 October 2003 and that any alteration, variation, or extension to the use, for which approval has been given would require further approval from Council.
