Judgment
- COMMISSIONER: This appeal concerns an application to modify a development consent for an existing centre-based child care facility in Belmore. At first blush, the application seems a modest one, involving the increase in the number of children who can be cared for at the facility from 38 to 42. However, a consequence of this increase is that the applicable outdoor unencumbered space requirements will not be met which, in turn, results in the Court being unable to approve the application without the concurrence of the Regulatory Authority. As that concurrence has not been given, the application must be refused.
The Site
- The land the subject of the application is described as Lot 102 DP 1206835 and is known as 29 Trafalgar Street, Belmore (Site). The Site is located on the north-western corner of Trafalgar Street and Garden Street and has an area of 800 m2. It has a frontage to Trafalgar Street of 21.6 m and to Garden Street of 26.38 m.
