In this case we have given some consideration to the question which has been argued, but we came to the conclusion that we were not able to dispose of the matter, in the first instance at all events, upon that ground. I have asked Williams J. if he would be good enough to be a member of the Court in case the matter had to be re-argued. The attitude of the parties to the other question of judicial proceedings has not been stated to the Court. We do not know whether Mr. Phillips intends to maintain that the subject proceedings were judicial proceedings.
