(4) Orders 4 to 7 inclusive concerned directions with respect to claims for costs.
(5) The Decision Under Appeal
Relevant Provisions of Strata Schemes Management Act and the Tribunal's Reasons
160 Owners corporation to insure building
(1) The owners corporation for a strata scheme for the whole of a building must insure the building and keep the building insured under a contract of insurance, in accordance with this Division, that insures the building if it is destroyed or damaged by fire, lightning, explosion or any other occurrence specified in the policy (a "damage policy" ).
: Maximum penalty--5 penalty units.
(2) The owners corporation for each strata scheme for part of a building and any other person in whom is vested an estate in fee simple in part of the building that is not included in the parcel of the strata scheme must insure the building and keep the building insured under a damage policy.
: Maximum penalty--5 penalty units.
(3) In any proceedings for an offence under subsection (2), it is a defence to establish that the defendant was willing to join in the insurance of a building under a damage policy but that the policy could not be taken out because another person specified in that subsection was unwilling to join in the application for that policy.
(4) This section does not apply to an owners corporation for a strata scheme comprising 2 lots if--
(a) the owners corporation so determines by unanimous resolution, and
(b) the buildings comprised in one of those lots are physically detached from the buildings comprised in the other lot, and
(c) no building or part of a building in the strata scheme is situated outside those lots.
(5) A damage policy may consist of one or more policies of insurance.
161 Requirements for damage policy
(1) General requirements The damage policy for a building must be with an approved insurer, be in the name of the owners corporation, and any other person required to insure under section 160 and provide for the following--
(a) the building is to be insured for at least the amount determined in accordance with the regulations,
(b) if the building is destroyed, the building is to be rebuilt or replaced so that the condition of every part of the rebuilt or replacement building is not worse or less extensive than that part when new,
(c) if the building is damaged but not destroyed, the damaged part of the building is to be repaired or restored so that the condition of the repaired or restored part is not worse or less extensive than that part when new,
(d) expenses incurred in removing debris are payable,
(e) the remuneration of architects and other persons whose services are necessary as an incident to the rebuilding, replacement, repair or restoration is payable.
(2) Limited sum liability Instead of providing for work and payments being made if a building is destroyed or damaged, the damage policy may limit the liability of the insurer in that event to an amount specified in the policy. The amount must not be less than an amount calculated in accordance with the regulations.
(3) Parts of building to be covered The parts of a building to be covered by a damage policy include the following--
(a) owners' improvements and owners' fixtures forming part of the building,
(b) a building consisting entirely of common property,
(c) anything prescribed by the regulations as forming part of a building for the purposes of this section.
(4) Parts of building not required to be covered The following parts of a building are not required to be covered by a damage policy--
(a) fixtures removable by a tenant at the expiration of a tenancy,
(b) owners' improvements and fixtures comprising paint, wallpaper and temporary wall, floor and ceiling coverings,
(c) anything prescribed by the regulations as not forming part of a building for the purposes of this section.
162 Insurance premiums where strata scheme is for part only of building
(1) This section applies if a requirement is imposed on an owners corporation for a strata scheme for part of a building and any other person to insure the building under a damage policy.
(2) The premium for a damage policy is to be paid by the owners corporation or other person according to the proportion that the replacement value of the part (or parts) of the building subject to the strata scheme or held in fee simple by the other person bears to the replacement value of the whole building.
(3) The Tribunal may, on application by an owners corporation or other person liable to pay a proportion of a premium, determine the replacement value and proportion payable. The determination is binding on each person liable to pay a proportion.
(4) The Tribunal may, on application by any person liable under this section to pay a proportion of a premium, make an order adjusting the proportion payable by a person to reflect that the use to which a part of a building in which that person has the fee simple is put causes an insurance premium under this section to be greater than it would be if it were not put to that use.
(1) Strata Scheme 67607 is a person liable to pay a proportion of an insurance premium and therefore able to make an application under s 162(4).
(2) Strata Scheme 67608 is also liable to pay a proportion of a premium.
(3) Strata Scheme 67608 has the fee simple in the commercial section of the building.
(4) The use to which the commercial section of the building has been put, specifically, lots 10 and 11, has caused an insurance premium to be greater than it would be, if it were not put to that use.
(1) In the year 2022-2023 the actual premium paid was $330,376.80 of which Strata Scheme 67607 was responsible for $297,339.12 pursuant to the split as set out in the SMS (being 90%).
(2) Accepting Mr Driscoll's evidence a premium of $67,142.36 would have been incurred had there been no business of the kind operated by PINN.
(3) Strata Scheme 67607 would have been responsible for $60,428.12 of that premium.
(1) In the year 2023-2024, the actual premium paid was $254,268.36 of which Strata Scheme 67607 was responsible for $228,841.52 (constituting 90% of the whole).
(2) Based on Mr Driscoll's evidence, the premium would have been $76,734.38 but for the business operated by PINN.
(3) Strata Scheme 67607 would have been responsible for $68,517.34 of that premium (based on the 90%:10% split referred to in the SMS).
(1) The amount paid by the Building Management Committee in respect of the Breeze policy was in respect of a policy that did not comply with either the Strata Act or the relevant provisions of the SMS.
(2) The amount paid by the Building Management Committee in respect of the isStrata policy is for a policy that does not comply with either the Strata Act or the SMS, for different reasons.
(3) Strata Scheme 67607 and Strata Scheme 67608 have determined in the SMS how insurance costs, together with other costs, were to be allocated. They did so in the context of an SMS which had machinery that provided for a variation of the allocation, and Strata Scheme 67607 has not sought to engage that process before commencing these proceedings.
(4) Strata Scheme 67607 has, by commencing these proceedings, ignored the dispute resolution procedures and requirements in the SMS.
(1) On 6 February 2025, Strata Scheme 67608 lodged its appeal. We will refer to that as the 67608 Appeal.
(2) On 7 February 2025, PINN lodged its appeal (the PINN Appeal).
(3) On 18 March 2025 Strata Scheme 67607 lodged its appeal (the 67607Appeal).
(1) The notice states that the appeal is an appeal in respect of orders 1 and 2 only and that the appeal does not concern orders 3 to 7.
(2) Ground 1: the Strata Scheme contends on questions of law that the Tribunal erred by identifying the wrong issue or asking the wrong question when framing: "The critical issue is whether the Respondent has the fee simple of the relevant part of the building, the Commercial Strata Scheme" (Decision at [74]).
(3) Alternatively, the Tribunal erred by applying the wrong legal principle to the facts by treating the relevant part of the building, for the purposes of s 162(4) as the commercial strata scheme.
(4) The correct position is that Strata Scheme 67608 has a fee simple in the common property of that strata scheme, and its use did not cause an increase in insurance premium.
(5) Ground 2: the Tribunal erred by applying the wrong legal principle to the facts or by applying an improper construction of s 162(4) by treating Strata Scheme 67608 as the owner of all lots in SP 67608 (Decision at [76]).
(6) The error is exhibited at [76] where the Tribunal states that it finds that the "respondent owners corporation being the owners of all the lots in Strata Plan 67608 as well as the owner of the common property that was created on the registration of Strata Plan 67608 has the fee simple to the relevant part of the building, namely the commercial strata scheme".
(7) The correct position is that Strata Scheme 67608, as the owners corporation of SP 67608 owns the common property, but not the lots in the scheme which are owned by the lot owners of the scheme.
(8) Ground 3: the Tribunal erred in drawing the wrong inference of fact from the primary facts when concluding that the respondent owners corporation has the fee simple to the relevant part of the building, the commercial strata scheme (Decision at [76]).
(9) The primary facts were:
(a) the respondent owners corporation has the fee simple in the common property of the commercial strata scheme; and
(b) PG Petersham Pty Ltd has the fee simple in lots 10 and 11 in the commercial strata scheme.
(10) The correct position/inference from these primary facts is that the Strata Scheme 67608 did not have the fee simple in the relevant part of the building for the purposes of s 162(4).
(11) Ground 4: the Tribunal erred by applying an improper construction of s 162(4) when holding that the person who has the fee simple in the relevant part of the building does not need to be the same person who causes the insurance premium to increase.
(12) This error is exhibited at [79] of the Decision where the Tribunal stated that "s162(4) is in my view to be interpreted on a wider basis than the person who has the fee simple of the relevant part of the building must be the same person whose use of that part of the building causes the insurance premium to be greater than it would have been if it were not put to that particular use".
(13) The correct position is, on a proper construction of s 162(4), the person who has the fee simple of the relevant part of the building must also be the same person who causes an increase in the insurance premium. The last two references to "person" in s 162(4) should be construed as referring to the same person.
(1) The Tribunal erred in finding that, on its proper construction, s 160(2) applied to the strata scheme comprising Strata Plans 67607 and 67608 in circumstances where the building, the subject of the obligation to insure was comprised of two strata schemes and there was no other person of the kind referred to in s 160(2) with an obligation to insure any other part of the building.
(2) The Tribunal erred in failing to find that the ability of Strata Scheme 67607 and Strata Scheme 67608 to vary the allocation of insurance costs provided for in the SMS required pursuant to s 99(1) of the Strata Development Act, was governed by the combined effect of the SMS and the Strata Act_,_ and not by s 160 of the Strata Act.
(3) The Tribunal erred in making an order against Strata Scheme 67608 pursuant to s 162(4) of the Strata Act in circumstances where Strata Scheme 67608 (which only held the fee simple in respect of the common property of Strata Plan 67608) did not hold the fee simple in respect of lots 10 and 11 of Strata Plan 67608; they being the lots, the use of which was said to have caused the relevant insurance premium to be greater than would otherwise have been the case; this being the only basis upon which an order could be made under s 162(4).
(4) The Tribunal erred in making the findings at [69] of the Decision that:
(a) in the case of the insurance year 2022/2023 the CHU premium would have been $67,142.36; and
(b) in the case of the insurance year 2023/2024 the premium would have been $76,130.63.
(5) The Tribunal erred in making the replacement findings at [70] and [71] of the Decision that:
(a) in the case of the insurance year 2022/2023 Strata Scheme 67607 would have been responsible for $60,428.12 of the CHU premium; and
(b) in the case of the insurance year 202/2024, Strata Scheme 67607 would have been responsible for $68517.34 of that premium.
(6) In the premises, the Tribunal erred in making orders 1 and 2 adjusting Strata Scheme 67607's proportion of the premium to $60,428.12 in the case of 2022/2023 and $68,517.34 in the case of 2023/2024.
(7) In making order 1 the Tribunal erred on the basis that the insurance policy issued by Breeze for the period 22 August 2022 to 22 August 2023 for an annual premium of $525,615 did not comply with s 161(c) of the Strata Act and Regulation 39 of the Strata Scheme Management Regulation 2016 (NSW) (the Strata Scheme Management Regulation) in that the policy did not cover the replacement value of the building, the declared value of which at the time was $38,560,000 in the event of a loss of the building as a whole, and was limited to $10 million of coverage in respect of any one loss or series of losses arising out of any one event.
(8) In making order 2, the Tribunal erred in not addressing and/or failing to consider the argument of PINN that no order should have been made under s 162(4) of the Strata Act in respect of the policy issued by isStrata and ARX Placement Solutions Pty Ltd for the 2023/2024 year on the basis that the policy did not comply with s 161(a) of the Strata Act in that the supporting insurer in respect of that policy was not, despite a concession from Strata Scheme 67607 to that effect an approved insurer within the meaning of the Insurance Act 1973 (Cth).
(1) The Tribunal erred by failing to consider and address the relief sought by Strata Scheme 67607 at paragraph 25(a) of the Amended Points of Claim that pursuant to s 162(3) of the Strata Act that the Tribunal determine the proportion of insurance premiums payable by Strata Scheme 67607 according to the proportion that the replacement value of that part of the building bears to the replacement value of the whole building.
(2) The Tribunal erred at [65] and [4] of the Decision by concluding that Strata Scheme 67607 had not sought relief under s 162(2) because s 162(2) is not the source of the power to seek relief under the Strata Act where the premiums are not paid according to the proportion that the replacement value of the part of the building subject to the strata scheme or held in fee simple by another person bears to the replacement value of the whole building, and s 162(3) is the source of the power to order to determine the replacement value and proportion payable and Strata Scheme 67607 sought relief under s 162(3) at paragraph 25(a) of the Amended Points of Claim.
(3) Strata Scheme 67607 pressed and did not abandon the claim for relief under s 162(3) at the hearing
The submissions of Strata Scheme 67608 in support of its appeal
(a) standing: "any person liable under this section to pay a proportion of a premium";
(b) purpose of order: "make an order adjusting the proportion payable by a person";
(c) basis for adjustment: "to reflect that the use to which a part of the building in which that person has the fee simple is put";
(d) nexus to insurance premium: "causes an insurance premium under this section to be greater than it would be if it were not put to that use."
Submissions of Strata Scheme 67607 in opposition to the appeal lodged by Strata Plan 67608
82 Individual contributions may be larger if greater insurance costs
(1) If the use to which a lot in a strata scheme is put causes an insurance premium for the strata scheme to be greater than it would be if it were not put to that use, so much of a contribution payable by the owner of the lot as is attributable to insurance premiums may, with the consent of the owner, be increased to reflect the extra amount of the premium.
(2) The Tribunal may, on application, make an order for payment of contributions of a different amount to one or more contributions levied or proposed by an owners corporation on an owner if the Tribunal is of the opinion that the owner's consent has been unreasonably refused under this section.
(3) An application for an order under this section may be made by the lessor of a leasehold strata scheme, an owners corporation, an owner of a lot or a mortgagee in possession.
The Appeal of 67608: Submissions of Strata Scheme 67608 in reply to the submissions of Strata Scheme 67607
(a) clause 34 requires the committee (being the body identified in the SMS to manage the provisions of the SMS) to effect insurance according to the Strata Act, and insure the building under a damage policy with an approved insurer for the value of the building comprising the two Strata Schemes that make up the building indicated by the last valuations obtained in accordance with clause 34, which clause also provides that a valuation must be obtained every two years;
(b) the term "damage policy" is defined in clause 1.1 by reference to the meaning in s 82 of the Strata Schemes Management Act 1996 NSW. The term "approved insurer" is defined by reference to the meaning in th_at Act_. Schedule 2 of the SMS apportions the insurance cost as to 90% to Strata Scheme 67607 and 10% to Strata Scheme 67608.
(i) a building made up of a strata scheme and non-strata component ie. where there is another person (or persons) who hold the fee simple for a part of the building that does not form part of the strata scheme; or
(a) a building made up of two or more strata schemes and a person or persons who hold the fee simple for a part of the building that does not form part of the strata scheme.
(a) A building containing a strata plan is to have the benefit of a compliant damage policy; more specifically, a contract of insurance in accordance with division 1 that insures the building if it is destroyed or damaged by fire, lightning, explosion or any other occurrence;
(b) subject to s 160(4) the obligation is to insure the whole building, regardless of whether:
(i) the Strata Scheme includes the whole building, see s 160(1); or
(ii) the building is comprised of one or more strata schemes and other land vested in fee simple in a third party, the "other person", and not forming part of the strata scheme or schemes;
(c) this means that there is a need to provide for a situation where the building has strata and non-strata components;
(d) on this basis, both the strata scheme and the "other person" owner have an obligation to insure and keep insured the whole building.
(a) to provide a mechanism for determining the proportion of the premium of the damage policy that each strata scheme and the "other person" are required to pay;
(b) to provide a mechanism for the Tribunal to determine the replacement value and the proportion payable; and
(c) make an order adjusting the amount payable where the use by a party makes the insurance premium to be paid under s 162(2) greater than it otherwise would be;
Submissions of Strata Scheme 67607 in opposition to PINN's appeal
(i) a building made up of a single strata scheme must insure the building under a damage policy: s 160(1);
(ii) a building made up of two or more strata schemes has no obligation to insure the building under a damage policy;
(iii) a building made up of a single strata scheme and a non-strata component, must insure the building under a damage policy;
(iv) a building made up of two more strata schemes and a non-strata component must insure the building under a damage policy.
PINN'S Appeal: Submissions of PINN in reply to submissions of Strata Scheme 67607
(1) A building wholly comprised of a single strata scheme must be insured by the strata scheme: s 160(1).
(2) A building wholly comprised of two or more strata schemes must be insured by the strata schemes: s 160(1).
(3) A building comprised of a single strata scheme and no strata component must be insured by the strata scheme and the other owners: s 160(2).
(4) A building promising two or more strata schemes and a non-strata component must be insured by the strata schemes and the other owner: s 160(2).
Submissions of Strata Scheme 67607 in support of its appeal
67607 APPEAL: Submissions of PINN in opposition to the appeal lodged by Strata Scheme 67607
67607 APPEAL: Submissions of Strata Scheme 67608 in opposition to the appeal lodged by Strata Scheme 67607
(1) Strata Scheme 67607 owns the common property in part of the building in which the other part of the common property of the same building is owned by Strata Scheme 67608.
(2) A company that is not a party to these proceedings owns the fee simple in lots 10 and 11 in Strata Scheme 67608 and leases those lots to PINN.
(3) PINN has put lots 10 and 11 to a use which has caused the premiums payable in respect of insuring the building to be much greater than would have been the case had that use not occurred. This is the finding at [24] of the Decision.
(1) Appeal 2025/00048270 (the appeal lodged by Strata Scheme 67608) is dismissed.
(2) Appeal 2025/00049917 (the appeal lodged by PINN 386 Pty Ltd) is dismissed.
(3) Appeal 2025/00114465 (the appeal lodged by Strata Scheme 67607) is upheld and time is extended for lodgement of that appeal.
(4) The following determinations are made pursuant to s162(3) of the Strata Schemes Management Act 2015: the replacement value of the building the subject of these proceedings for the period 2022-2023 and 2023-2024 is $37,052,400.00 and the proportion of the insurance premiums payable by Strata Scheme 67607 is 81% and the proportion payable by Strata Scheme 67608 is 19%.
(5) If Strata Scheme 67607 seeks further or other orders in this appeal it is directed to file and serve an application within 21 days. Note: Such an application is limited to orders sought in the appeal by Strata Scheme 67607 but not made by the appeal panel.
(6) If Strata Scheme 67607 seeks an order for costs of the appeals it must file and serve its submissions and evidence in support within 21 days.
(7) If Strata Scheme 67608 and/or PINN oppose the application for costs lodged by Strata Scheme 67607, they must file and serve submissions and evidence in reply within 14 days thereafter.
(8) Submissions on costs should include a submission as to whether the Appeal Panel may determine costs on the papers and in doing so, dispense with a further hearing.
I hereby certify that this is a true and accurate record of the reasons for decision of the Civil and Administrative Tribunal of New South Wales.
