Powers of Attorney Act 2014 (Vic), standing, decision making capacity, Victorian Civil and Administrative Tribunal Act 1998 (Vic) section 75.
It is not appropriate for the Tribunal, in exercising its power under s 75 of the VCAT Act, to effectively conduct a pre-trial assessment to determine if the complainant can prove its case.
...
The respondent has an onus of showing the complaint is undoubtedly hopeless, unsustainable, and bound to fail, or that there is no reasonable question to be tried. This places a heavy burden on the respondent in making out a case for summary dismissal. It is not enough for the respondent to show that the proceeding against the respondent is weak.
