Planning scheme Tasmanian Planning Scheme - West Tamar
Amendment AMD03-24 - to apply the Low Density Residential Zone and Residential Supply and Density Specific Area Plan to part of the land at 11 Upper McEwans Road, Legana.
Permit PA-2024-132 - a three lot subdivision of the land at 11 Upper McEwans Road, Legana.
The draft amendment is rejected under section 40N(1)(c) and the planning authority is directed to submit to the Commission a substitute draft amendment under section 40N(1)(c)(i) of the Land Use Planning and Approvals Act 1993 as set out in Annexure A.
The permit is refused under section 42B(1)(d) of the Land Use Planning and Approvals Act 1993.
The draft amendment proposes to apply the Low Density Residential Zone and the WTA-S3.0 Residential Supply and Density Specific Area Plan (the SAP) to land at 11 Upper McEwans Road, Legana (folio of the Register 174506/1).
The permit provides for a three lot subdivision to the land at 11 Upper McEwans Road, Legana.
The subject site is part of a split-zoned parcel. The entire lot is 1.658ha, with approximately 1,000m2 included in the Low Density Residential Zone and the remainder of the lot is included in the Agriculture Zone. The SAP only applies to the portion of the lot zoned Low Density Residential.
The part of the lot subject to this draft amendment (the subject site) is entirely contained within the Agriculture Zone. The land is subject to the Bushfire-Prone Areas Code and some of the land is subject to the Landslip Hazard Code.
The subject site contains an existing dwelling and garden, and this land is listed as Urban Areas and the rest of the land is listed as Agricultural land in the TasVeg 4.0 mapping. The land is listed as unconstrained in the Land Potentially Suitable for Agriculture layer in the LISTmap.
There is no vegetation visible in the imagery and no native grasses identified in the TasVeg mapping.
Land to the north and east is zoned Low Density Residential and included in the SAP. Land to the south and west is zoned Agriculture.
Three representations were received during the exhibition period of the draft amendment and related permit. The representators raised the following:
The draft amendment and related permit were referred to TasWater under sections 56S and 56O of the Water and Sewerage Industry Act 2008.
In response TasWater advised they had no objection to the draft amendment and provided a submission to planning authority notice (SPAN) providing conditions to be included with any permit. TasWater stated they did not wish to attend a hearing.
These issues and any additional matters raised by representors at the hearing are discussed as relevant below.
Planning authority's response to the representations
The planning authority considered the representations and recommended that no modifications to the draft amendment were required, but the following modifications were required to the related permit:
(a) A 3.0m wide drainage easement, benefitting West Tamar Council, along the north-western boundary of lots 1-3, which connects to Upper McEwans Road in lot 1 via the perimeter of the property described in Certificate of Title Volume 165613 Folio 2.

Suitability of the Zone and application of the Specific Area Plan
State Policy on the Protection of Agricultural Land 2009
'The size of the property is 1.66ha, which is not considered suitable for agricultural use. It has been indicated that considerable inputs would be required on the land in order to realise any minimum commercial value. The site is in close proximity to existing residential areas, with the rear of the property adjoining rocky, steep portions of land that are not suitable for agricultural production. > > The agricultural report indicates the potential for spray drift from adjoining properties is offset as a result of historic weather data. The adjoining operator is classified as an 'organic entity', which provides strict guidelines in relation to spray activities. The activities used for spraying purposes (as a result of their organic classification) are considered to have a much softer impact on the surrounding environment than non-organic operators. > > It is considered that conversion of the site to allow residential use and development, is consistent with the relevant principles of the PAL policy.'
'In response to representations received, Council engaged Nicholbrook Horticultural Consultants to undertake a peer review of the Walker Ag report. The peer review ultimately concluded that the rezoning and subdivision of land was appropriate and that the site could not be used for a viable agricultural activity. The report stated there was insufficient scale for an agricultural use, other than for a "hobby" activity. The peer review considered the PAL policy as part of its analysis when undertaking the review. '
'The subject land has limited ecological value. No adverse impacts are expected on the air, adjacent land and water resources, including the Tamar River and the subject land is not identified to contain historical or aboriginal heritage values.'
'The amendment is considered to not conflict with or interfere with natural or cultural values of the coastal zone, having regard to; > > - The subject site has not been identified as containing ecological values; > > - There are no expected adverse impacts on air, adjacent land, and water resources, including the Tamar River; > > - The land contains an existing dwelling, and is located within an existing residential settlement; > > - The rezoning is not classified as ribbon development or an isolated node of residential development; and > > - The site is connected to existing services, including stormwater. The stormwater system is maintained by West Tamar Council as the stormwater authority.
'The subject land has access to reticulated water and stormwater services. A wastewater report demonstrates that all proposed lots are capable of accommodating on-site wastewater systems. The existing provisions within the Tasmanian Planning Scheme - West Tamar are applicable to the site and therefore will ensure that any existing or future use or development on the site is consistent with this policy.'
'The subject land has access to reticulated water and stormwater infrastructure. An onsite wastewater assessment by Tasman Geotechnics has been provided which demonstrates that given the size of the proposed lots, there is adequate area available on each lot for proposed wastewater disposal.'
(a) a use or development to which the provision relates is of significant social, economic or environmental benefit to the State, a region or a municipal area; or
(b) the area of land has particular environmental, economic, social or spatial qualities that require provisions, that are unique to the area of land, to apply to the land in substitution for, or in addition to, or modification of, the provisions of the SPPs.
(a) make an application to the planning authority for a permit, which permit could not be issued unless the LPS were amended as requested; and
(b) request the planning authority to consider the request to amend the LPS and the application for a permit at the same time.
Substitute draft amendment AMD03-24 to the Tasmanian Planning Scheme - West Tamar.
