Planning scheme Tasmanian Planning Scheme - Brighton
Amendment RZ 2025-01 - Rezone land at Tea Tree from Rural and Agriculture to Community Purpose
Permit SA 2025-004 - Subdivision (reorganisation of boundaries) and ancillary site works
Applicant PDA Surveyors, Engineers and Planners for Tea Tree Community Association Incorporated
The draft amendment is modified under section 40N(1)(b) of the Land Use Planning and Approvals Act 1993 as set out in Annexure A and is approved under section 40Q.
The permit is modified under section 42B(1)(b)(ii) of the Land Use Planning and Approvals Act 1993, as set out in Annexure B.
The permit provides for the land to be developed by subdivision (reorganisation of boundaries) and ancillary site works.
The proposed development is to undertake a subdivision of the property at 594 Tea Tree Road, Tea Tree (folio of the Register 182250/1) to produce 2 lots; Lot 1 (0.44ha) and Lot 2 (43.45ha), as shown in Figure 1 below.
Lot 1 is proposed be absorbed into the existing adjoining title at 596 Tea Tree Road, Tea Tree (folio of the Register 164781/1).
Lot 2 would subsequently return to a single title and be made up of the balance of 594 Tea Tree Road, Tea Tree (folio of the Register 182250/1).

The site is located at 594 and 596 Tea Tree Road, Tea Tree, comprising two titles with an approximate combined area of 44.63ha. The site is accessible from Tea Tree Road via a public internal road - Briar Banks Road.
The property at 594 Tea Tree Road, Tea Tree is zoned Agriculture and contains a residential dwelling (and an associated outbuilding) surrounded by grassland currently utilised for grazing.
The property at 596 Tea Tree Road, Tea Tree is zoned Rural and currently accommodates the Tea Tree Community Hall and associated outdoor public use area.
The land surrounding the site is zoned Agriculture to the south, Rural to the east and Utilities to the north where it adjoins the State Rail Network.
Areas of the site are subject to the Bushfire-Prone Areas Code, Landslip Hazard Code and the Natural Assets Code overlays.
The property at 594 Tea Tree Road, Tea Tree is not connected to reticulated water or sewer. The property at 596 Tea Tree Road, Tea Tree is not connected to sewer, however is connected to a reticulated water service. Both properties are serviced by existing onsite waste water systems.
(a) The proposal was referred to TasWater under sections 56S and 56O of the Water and Sewerage Industry Act 2008. In response TasWater advised that it does not object to the proposal and does not need to attend any hearing.
(b) Several other relevant State Agencies were notified of the proposal and provided responses to the planning authority.
(c) TasNetworks and the Department of Natural Resources and Environment Tasmania advised that they had no objection to the proposal.
(d) TasRail advised the planning authority that developments that are adjacent to the State rail corridor, should comply with TasRail's standard notes.
(e) No other representations were received during the exhibition period.
Planning authority's response to the representations
The planning authority considered the representations and recommended that:
(a) the representations do not warrant modifications to the draft amendment, and
(b) the draft permit be modified to attach and include reference to TasRail's Standard Notes.
(a) contains all the provisions that the SPPs specify must be contained in an LPS; and
(b) is in accordance with section 32; and
(c) furthers the objectives set out in Schedule 1; and
(d) is consistent with each State policy; and
(da) satisfies the relevant criteria in relation to the TPPs; and
(e) as far as practicable, is consistent with the regional land use strategy, if any, for the regional area in which is situated the land to which the relevant planning instrument relates; and
(f) has regard to the strategic plan, prepared under section 66 of the Local Government Act 1993, that applies in relation to the land to which the relevant planning instrument relates; and
(g) as far as practicable, is consistent with and co-ordinated with any LPSs that apply to municipal areas that are adjacent to the municipal area to which the relevant planning instrument relates; and
(h) has regard to the safety requirements set out in the standards prescribed under the Gas Safety Act 2019.
(a) will allow the property at 594 Tea Tree Road, Tea Tree, to continue to be managed for agricultural activity at the current scale and intensity; and
(b) is anticipated to have negligible impacts on the capability of the land for agricultural use.
PR 2.5 Provide flexibility for commercial and tourism uses provided that long-term agriculture potential is not lost and does not further fetter surrounding agricultural land.
As outlined in the submitted Agricultural Assessment and Compliance Report [agricultural assessment], the amendment will not fetter the use of surrounding agricultural land. The proposal is therefore considered to be consistent with the strategic intent of both community development and agricultural land protection.
1.2 Build resilience and opportunity > > 1.3 Ensure attractive local areas that provide social, recreational and economic opportunities > > 1.4 Community facilities are safe, accessible and meet contemporary needs > > 1.5 Advocate and facilitate investment in our region > > 1.6 Ensure strong engagements and relationships to shape the agenda and advocate for our community
Action 06 Increase opportunities for the community to participate in cultural and creative activities > > Action RE01 Opportunities to increase local cultural practice through programs with vineyards and 'public-facing' rural-commercial to encourage events and cultural creation - as well as stimulate the local economy. Consider partnership with rural community organisations to drive funding for events in the region and identify opportunities to consolidate and promote existing cultural offerings.
It is considered that 596 Tea Tree Road and 4,401 sqm of adjoining land at 594 Tea Tree Road could be consolidated to form a new lot for the Tea Tree Community. The newly created lot from the boundary adjustment would have a split zoning of Rural and Agriculture under the Tasmanian Planning Scheme - Brighton, which is not ideal for future expansion of activities as the Community Meeting and Entertainment use class is prohibited within the Agricultural Zone. > > To support the long-term use of the site, it is recommended rezoning the land to Community Purpose.
There is no agricultural activity undertaken on the subject property at 596 Tea Tree Road (TR:164781/1). This title is best considered and assessed under the provisions of the Tasmanian Planning Scheme - Community Purpose Zone. > > The 594 Tea Tree Road (TR: 182250/1) property is currently utilised for low intensity, dryland pastoral use (livestock grazing) on semi-improved and unimproved pasture. A small beef cattle finishing enterprise is currently operating on the subject property and consists of approximately 7 steers. The landowner intends to maintain the enterprise at the current level of intensity and scale. On the far northwestern corner, as would be covered by the proposed Lot 2 is currently utilised as car parking area for the 596 Tea Tree Road (TR: 164781/1) (as per Tea Tree Community Hall).

In its supporting report, the planning authority considered that the draft amendment furthers the objectives of the Act as:
(a) the draft amendment facilitates more effective and efficient use of the land
(b) the application of the Community Purpose Zone will promote better opportunities and uses of the hall, and
(c) the land to be rezoned is not suitable for agricultural uses.
(a) amend the draft amendment mapping to include adjacent road casement to comply with Commission drafting practices
(b) amend the title references to provide clarity and to align with the Commission's drafting practices.
