(a) To the extent that the primary judge did in fact rely upon an expert report ("the child wishes report") given she was being asked to make consent orders, she was not in error. The appellant (together with his legal advisers) made forensic decisions about the nature and extent of the evidence, and when and if to test the evidence. No error is established.
(b) The appellant's application before the primary judge sought equal time orders. It is difficult to understand how then, on appeal, he submits that the primary judge's alleged failure to consider the respondent's risk factors when making consent orders was material and amounted to legal error.
(a) The fact that the appellant was wholly unsuccessful;
(b) The fact that the appellant had made an early offer of settlement;
(c) The fact that the flaw in the appellant's approach had been drawn to his attention by the Appeal Judicial Registrar when the appellant was provided with the authorities which relate to appeals against consent orders.
(a) Where it appears that an action has been commenced or continued in circumstances where a party properly advised should have known that he had no chance of success. In such cases the action must be presumed to have been commenced or continued for some ulterior motive or because of some wilful disregard of the known facts (see Fountain Selected Meats (Sales) Pty. Ltd. v. International Produce Merchants Pty. Ltd. [1988] 81 ALR 397.
