COMMISSIONER: These proceedings arise following an application to the Court under s 4.55(8) of the Environmental Planning and Assessment Act 1979 (NSW) (the EPA Act) to modify development consent DA-21-01394 (the consent) in Tallawong Road Pty Ltd v Blacktown City Council [2023] NSWLEC 1564 (Tallawong v Blacktown). That decision granted approval for the Torrens title residential subdivision of 1 lot into 61 lots including demolition, tree removal, new roads, construction of 50 dwellings on proposed lots 109-113, 115-134, 135-154 and 156-160, associated site earth and drainage works, and retaining walls at 165 Guntawong Road Rouse Hill (Lot 46 DP 30186).
The Modification Application lodged with the Court on 1 April 2025 proposes the following changes to the consent:
Amend the approved staging of the development to allow the release of additional lots prior to the reconstruction of Tallawong Road by the Respondent, by undertaking retain and other civil works.
Amendment to the drainage alignment.
The completion of earthworks, construction of retaining walls, stairs and associated works.
The Court arranged a conciliation conference under s 34(1) of the Land and Environment Court Act 1979 (NSW) (LEC Act) between the parties, which was held on 7 July 2025. Following the conciliation conference, the Applicant and the Respondent continued discussions but the conference was ultimately terminated, and the matter was listed for hearing. Prior to the hearing the parties reached agreement and requested a further conciliation conference. The Court arranged a further conciliation conference between the parties, which was held on 9 February 2026. I presided over the further conciliation conference. At the conciliation conference agreement was reached between the parties to approve the modification application. The terms of the parties’ agreement are outlined in their executed written agreement.
Under s 34(3) of the LEC Act, I must dispose of the proceedings in accordance with the parties’ signed agreement if the Court could have made that decision in the proper exercise of its functions. The preconditions relevant to the exercise of the Court’s power to make the proposed final orders are addressed in a joint jurisdictional submission annexed to the written agreement. In that regard, I note the following matters:
The Modification Application was made pursuant to s 4.55(8) of the EPA Act. The jurisdictional requirements for the Modification Application are contained in s 4.55(2) of the EPA Act.
The parties submit, and I accept, that the development to which the consent as proposed to be modified relates, is substantially the same development as the development for which consent was originally granted (and before that consent as originally granted was modified). In forming that view, I have had regard to the Statement of Environmental Effects (SEE) which details the scope of the amendments and that the remainder (the majority) of the development remains unchanged. The modification application seeks to amend DA-21-01394 by deleting the requirement for Tallawong Road to be reconstructed at a lower level before Stage 2 can be undertaken and in lieu to construct and subsequently remove a retaining wall. Thereby the only change to the development is the construction of a temporary retaining wall. Further, the modification application does not propose any change to the use, overall appearance, scale or form of the proposed development.
I am satisfied that the development to which the consent as modified relates is substantially the same development as the development for which consent was originally granted (and before that consent as originally granted was modified).
The second jurisdictional requirement under s 4.55(2)(b) of the EPA Act relates to consultation with relevant approval bodies.
The Modification Application is neither integrated nor designated development, and there are no applicable requirements to consult external authorities.
The requirements of s 4.55(2)(b) of the EPA Act are met.
The third jurisdictional requirement is for the application to be notified in accordance with the Environmental Planning and Assessment Regulation 2021 (NSW) (EPA Regulation). The parties agree, and I accept, that renotification is not required pursuant to s 108 of the EPA Regulation and because the Respondent formed the view that the amendments to the development did not increase its environmental impacts (Sch 1, Pt 2, s 23 of the EPA Act).
The requirements of ss 4.55(2)(c) and (d) of the EPA Act are met.
The Development Application was submitted with the consent, in writing, of the Director of the company who is the owner of the subject land as required by s 23(1) of the EPA Regulation.
The parties agree, and I accept, that the Modification Application does not affect the findings of the Court in Tallawong v Blacktown that:
Section 4.6 of State Environmental Planning Policy (Resilience and Hazards) 2021 are met.
The development remains compliant with the development standards and maintains access to the essential services required by s 6.1 in State Environmental Planning Policy (Precincts – Western Sydney Parklands) 2021.
The proposed development is not likely to significantly impact threatened species within the meaning of s 7.2 of the Biodiversity Conservation Act 2016 (NSW).
The requirements of s 4.55(3) of the EPA Act are met.
The reasons for granting consent are detailed in the judgment of Tallawong v Blacktown. The parties agree, and I accept, that the Modification Application does not seek to vary any of the reasons for the grant of the original development consent.
In determining the modification application, I have taken into consideration the reasons given by the consent authority for the grant of consent.
Having reached the state of satisfaction that the decision is one that the Court could make in the exercise of its functions, s 34(3)(a) of the LEC Act requires me to "dispose of the proceedings in accordance with the decision". The LEC Act also requires me to "set out in writing the terms of the decision" (s 34(3)(b)).
In making the orders to give effect to the agreement between the parties, the parties have not raised, and I am not aware of, any jurisdictional impediment to the making of these orders.
The Court notes that:
As part of their agreement the Respondent has approved, pursuant to s 38 of the Environmental Planning and Assessment Regulation 2021 (NSW) (EPA Regulation), the Applicant amending the modification application in accordance with the amended plans and documents as set out below:
