WINDING UP - preferential payments - commissioner's claim over against director - whether expectancy of insolvency - whether liability discharged.
Solicitor for the Deputy Commissioner of Taxation of the Commonwealth of Australia
The total in fact comes to $563,702.80, but nothing turns on the small discrepancy. The payments are admitted in the pleadings. I was told at the outset that the Liquidator and the Commissioner have agreed that the payments are voidable and that the appropriate repayment is $388,702.80, representing all of the first four payments and 50 per cent of the fifth.
"this amount was paid against the outstanding liabilities stated in the winding up application."
