Background
- This decision concerns an appeal lodged by a lot owner in a strata scheme constituted by the Respondent to this appeal, following a decision made by the Tribunal in the Consumer and Commercial Division published on 5 January 2024. The Tribunal was exercising its jurisdiction under the Strata Schemes Management Act 2015 (NSW) (the Strata Act).
- The proceedings in the Consumer and Commercial Division commenced when the Appellant lodged an application on 15 May 2023. This was followed by an application lodged by the Respondent and ultimately both applications were heard together on 12 December 2023. The nature of the orders sought in each application will become apparent later in these reasons.
- On 5 January 2024 the Tribunal published its written reasons and orders. The Appellant's application was dismissed and there was also an order that the Appellant pay the Respondent's costs. In respect of the proceedings commenced by the Respondent the Tribunal ordered the Appellant to pay the Respondent the sum of $15,105.62 and costs (subject to a proviso which we will set out later).
- The Appellant has lodged an appeal in respect of all of the orders made.
