[2017] FamCA 952
defendant. Leave refused to both parties; property trial unable to proceed as scheduled
In a high-stakes divorce involving $120 million in assets, both the husband and wife failed to follow court rules about when to file expert valuation evidence. The husband changed his expert report at the last minute and filed late. The wife sat on important property valuations for months, only handing them over right before trial. The judge refused to let either party use their late evidence, finding that both had seriously undermined the fairness of the trial. Even though this meant the trial would be delayed and cost more, allowing the late evidence would have been unfair to the other side.
